| 4 | Remove lines 3356-3366 and insert: |
| 5 | (1) Any business that evaluates, ranks, or rates another |
| 6 | business on the basis of a consumer complaint shall not be |
| 7 | liable for any damages caused to the business being evaluated, |
| 8 | ranked, or rated for any defamatory statement published or |
| 9 | uttered in or as a part of an evaluation, ranking, or rating of |
| 10 | a business unless it shall be alleged and proved by a |
| 11 | preponderance of the evidence by the complaining party that the |
| 12 | business that evaluated, ranked, or rated a business failed to |
| 13 | exercise due care to prevent the publication or utterance of |
| 14 | such statement. |
| 15 | (2) A business that evaluates, ranks, or rates another |
| 16 | business on the basis of a consumer complaint shall be entitled |
| 17 | to a presumption that due care was |
