4     Remove lines 3356-3366 and insert:
5     (1)  Any business that evaluates, ranks, or rates another
6business on the basis of a consumer complaint shall not be
7liable for any damages caused to the business being evaluated,
8ranked, or rated for any defamatory  statement published or
9uttered in or as a part of an evaluation, ranking, or rating of
10a business unless it shall be alleged and  proved by a
11preponderance of the evidence by the complaining party that the
12business that evaluated, ranked, or rated a business failed to
13exercise due care to prevent the publication or utterance of
14such statement.
15     (2)  A business that evaluates, ranks, or rates another
16business on the basis of a consumer complaint shall be entitled
17to a presumption that due care was
