4     Between lines 1028-1029, insert:
5     Section 15.  (1)  Beginning in fiscal year 2008-2009, the
6Legislature shall appropriate moneys to offset the reductions in
7ad valorem tax revenue experienced by fiscally constrained
8counties, as defined in s. 218.67(1), Florida Statutes, which
9occur as a direct result of the implementation of revisions of
10Article VII of the State Constitution approved in the special
11election held on January 29, 2008. The moneys appropriated for
12this purpose shall be distributed in January of each fiscal year
13among the fiscally constrained counties based on each county's
14proportion of the total reduction in ad valorem tax revenue
15resulting from the implementation of the revision.
16     (2)  On or before November 15 of each year, beginning in
172008, each fiscally constrained county shall apply to the
18Department of Revenue to participate in the distribution of the
19appropriation and provide documentation supporting the county's
20estimated reduction in ad valorem tax revenue in the form and
21manner prescribed by the Department of Revenue. The
22documentation must include an estimate of the reduction in
23taxable value directly attributable to revisions of Article VII
24of the State Constitution for all county taxing jurisdictions
25within the county and shall be prepared by the property
26appraiser in each fiscally constrained county. The
27documentation must also include the county millage rates
28applicable in all such jurisdictions for both the current year
29and the prior year; rolled-back rates, determined as provided
30in s. 200.065, Florida Statutes, for each county taxing
31jurisdiction; and maximum millage rates that could have been
32levied by majority vote pursuant to s. 200.185, Florida
33Statutes. For purposes of this section, each fiscally
34constrained county's reduction in ad valorem tax revenue shall
35be calculated as 95 percent of the estimated reduction in
36taxable value times the lesser of the 2007 applicable millage
37rate or the applicable millage rate for each county taxing
38jurisdiction in the prior year.
39     Section 16.  Section 9 of chapter 2007-339, Laws of
40Florida, is repealed.
