A bill to be entitled
2An act relating to water management districts; reenacting
3ss. 373.069, 373.0695, and 373.083, F.S., relating to the
4creation of the water management districts pursuant to the
5provisions of the Florida Government Accountability Act;
6reenacting and amending s. 373.0693, F.S.; eliminating the
7Oklawaha River Basin Advisory Council; reenacting and
8amending s. 373.073, F.S., relating to governing boards;
9revising provisions for the nomination and appointment of
10members to the governing boards of the water management
11districts; requiring the Florida Public Service Commission
12Nominating Council to provide nominations to the Governor;
13revising provisions relating to terms of office for board
14members; providing requirements and procedures for the
15nomination of board members; requiring the Department of
16Law Enforcement to conduct background investigations;
17providing that water management district governing board
18appointees are subject to Senate confirmation; amending s.
19373.079, F.S.; revising meeting requirements for water
20management district governing boards; amending s. 373.323,
21F.S.; revising requirements for water well contractor
22licensure examinations; requiring applicants to provide
23specified documentation; amending s. 373.503, F.S.;
24providing that millage rates for water management
25districts are subject to annual review and authorization
26by the Legislature; requiring the Legislature to set the
27maximum amount of revenue water management districts are
28authorized to raise from ad valorem taxes; providing an
29amount of authorized revenue under specified conditions;
30amending s. 373.536, F.S.; revising fiscal year dates for
31water management districts; revising the date by which
32water management districts must submit tentative budgets
33to the Governor and the Legislature; eliminating the
34authorization for the Legislature to comment on such
35budgets; eliminating requirements for water management
36districts to respond to such comments; revising the date
37by which the Executive Office of the Governor must file a
38specified report with the Legislature; directing districts
39to implement conforming budget and planning measures;
40providing an effective date.

42     WHEREAS, sections 11.901-11.920, Florida Statutes, the
43Florida Government Accountability Act, subject the water
44management districts and each district's respective advisory
45committees to a sunset review process in order to determine
46whether the districts should be retained, modified, or
47abolished, and
48     WHEREAS, the water management districts produced reports
49providing specific information, as enumerated in s. 11.906,
50Florida Statutes, and
51     WHEREAS, upon receipt of the reports, the Joint
52Legislative Sunset Committee and committees of the Senate and
53the House of Representatives assigned to act as sunset review
54committees reviewed the reports and requested studies by the
55Office of Program Policy Analysis and Government
56Accountability, and
57     WHEREAS, based on the reports of the water management
58districts, studies of the Office of Program Policy Analysis and
59Government Accountability, and public input, the Joint
60Legislative Sunset Committee and legislative sunset review
61committees made recommendations on the abolition, continuation,
62or reorganization of the water management districts and each
63district's advisory committees; on the need for the functions
64performed by the districts and the advisory committees; and on
65the consolidation, transfer, or reorganization of programs
66within the water management districts, NOW, THEREFORE,
67
68Be It Enacted by the Legislature of the State of Florida:
69
70     Section 1.  Section 373.069, Florida Statutes, is reenacted
71to read:
72     373.069  Creation of water management districts.--
73     (1)  At 11:59 p.m. on December 31, 1976, the state shall be
74divided into the following water management districts:
75     (a)  Northwest Florida Water Management District.
76     (b)  Suwannee River Water Management District.
77     (c)  St. Johns River Water Management District.
78     (d)  Southwest Florida Water Management District.
79     (e)  South Florida Water Management District.
80     (2)  Notwithstanding the provisions of any other special or
81general act to the contrary, the boundaries of the respective
82districts named in subsection (1) shall include the areas within
83the following boundaries:
84     (a)  Northwest Florida Water Management District.--Begin at
85the point where the section line between Sections 26 and 27,
86Township 4 South, Range 3 East intersects the Gulf of Mexico;
87thence north along the section line to the northwest corner of

694     Section 2.  Section 373.0693, Florida Statutes, is
695reenacted, and paragraph (a) of subsection (8) of that section
696is amended, to read:
697     373.0693  Basins; basin boards.--
698     (1)(a)  Any areas within a district may be designated by
699the district governing board as subdistricts or basins. The
700designations of such basins shall be made by the district
701governing board by resolutions thereof. The governing board of
702the district may change the boundaries of such basins, or create
703new basins, by resolution.
704     (b)  No subdistrict or basin in the St. Johns River Water
705Management District other than established by this act shall
706become effective until approved by the Legislature.
707     (2)  Each basin shall be under the control of a basin board
708which shall be composed of not less than three members, but
709shall include one representative from each of the counties
710included in the basin.
711     (3)  Each member of the various basin boards shall serve
712for a period of 3 years or until a successor is appointed,
713except that the board membership of each new basin shall be
714divided into three groups as equally as possible, with members
715in such groups to be appointed for 1, 2, and 3 years,
716respectively. Each basin board shall choose a vice chair and a
717secretary to serve for a period of 1 year. The term of office of
718a basin board member shall be construed to commence on March 2
719preceding the date of appointment and to terminate March 1 of
720the year of the end of a term.
721     (4)  Members of basin boards shall be appointed by the
722Governor, subject to confirmation by the Senate at the next
723regular session of the Legislature; and the refusal or failure
724of the Senate to confirm an appointment shall create a vacancy
725in the office to which the appointment was made.
726     (5)  Basin board members shall receive no compensation for
727services as such; but, while officially on work for the
728district, they shall receive their actual travel expenses
729between their respective places of residence and the place where
730official district business is conducted, subsistence, lodging,
731and other expenses in the amount actually incurred. These
732expenses may not exceed the statutory amount allowed state
733officers and employees. This subsection applies retroactively to
734the effective date of the creation of each of the five separate
735water management districts.
736     (6)(a)  Notwithstanding the provisions of any other general
737or special law to the contrary, a member of the governing board
738of the district residing in the basin or, if no member resides
739in the basin, a member of the governing board designated by the
740chair of the governing board shall be the ex officio chair of
741the basin board. The ex officio chair shall preside at all
742meetings of the basin board, except that the vice chair may
743preside in his or her absence. The ex officio chair shall have
744no official vote, except in case of a tie vote being cast by the
745members, but shall be the liaison officer of the district in all
746affairs in the basin and shall be kept informed of all such
747affairs.
748     (b)  Basin boards within the Southwest Florida Water
749Management District shall meet regularly as determined by a
750majority vote of the basin board members. Subject to notice
751requirements of chapter 120, special meetings, both emergency
752and nonemergency, may be called either by the ex officio chair
753or the elected vice chair of the basin board or upon request of
754two basin board members. The district staff shall include on the
755agenda of any basin board meeting any item for discussion or
756action requested by a member of that basin board. The district
757staff shall notify any basin board, as well as their respective
758counties, of any vacancies occurring in the district governing
759board or their respective basin boards.
760     (7)  At 11:59 p.m. on December 31, 1976, the Manasota
761Watershed Basin of the Ridge and Lower Gulf Coast Water
762Management District, which is annexed to the Southwest Florida
763Water Management District by change of its boundaries pursuant
764to chapter 76-243, Laws of Florida, shall be formed into a
765subdistrict or basin of the Southwest Florida Water Management
766District, subject to the same provisions as the other basins in
767such district. Such subdistrict shall be designated initially as
768the Manasota Basin. The members of the governing board of the
769Manasota Watershed Basin of the Ridge and Lower Gulf Coast Water
770Management District shall become members of the governing board
771of the Manasota Basin of the Southwest Florida Water Management
772District. Notwithstanding other provisions in this section,
773beginning on July 1, 2001, the membership of the Manasota Basin
774Board shall be comprised of three members from Manatee County
775and three members from Sarasota County. Matters relating to tie
776votes shall be resolved pursuant to subsection (6) by the ex
777officio chair designated by the governing board to vote in case
778of a tie vote.
779     (8)(a)  At 11:59 p.m. on June 30, 1988, the area
780transferred from the Southwest Florida Water Management District
781to the St. Johns River Water Management District by change of
782boundaries pursuant to chapter 76-243, Laws of Florida, shall
783cease to be a subdistrict or basin of the St. Johns River Water
784Management District known as the Oklawaha River Basin and said
785Oklawaha River Basin shall cease to exist. However, any
786recognition of an Oklawaha River Basin or an Oklawaha River
787Hydrologic Basin for regulatory purposes shall be unaffected.
788The area formerly known as the Oklawaha River Basin shall
789continue to be part of the St. Johns River Water Management
790District. There shall be established by the governing board of
791the St. Johns River Water Management District the Oklawaha River
792Basin Advisory Council to receive public input and advise the
793St. Johns River Water Management District's governing board on
794water management issues affecting the Oklawaha River Basin. The
795Oklawaha River Basin Advisory Council shall be appointed by
796action of the St. Johns River Water Management District's
797governing board and shall include one representative from each
798county which is wholly or partly included in the Oklawaha River
799Basin. The St. Johns River Water Management District's governing
800board member currently serving pursuant to s. 373.073(2)(c)3.
801shall serve as chair of the Oklawaha River Basin Advisory
802Council. Members of the Oklawaha River Basin Advisory Council
803shall receive no compensation for their services but are
804entitled to be reimbursed for per diem and travel expenses as
805provided in s. 112.061.
806     (b)  Also, the entire area of the St. Johns River Water
807Management District, less those areas formerly in the Oklawaha
808Basin, shall cease to be a subdistrict or basin of the St. Johns
809River Water Management District known as the Greater St. Johns
810River Basin and said Greater St. Johns River Basin shall cease
811to exist. The area formerly known as the Greater St. Johns River
812Basin shall continue to be part of the St. Johns River Water
813Management District.
814     (c)  As of 11:59 p.m. on June 30, 1988, assets and
815liabilities of the former Oklawaha River and Greater St. Johns
816River Basins shall be assets and liabilities of the St. Johns
817River Water Management District. Any contracts, plans, orders,
818or agreements of such basins shall continue to be in effect, but
819may be modified or repealed by the St. Johns River Water
820Management District in accordance with law. For all purposes for
821assessing and levying the millage rate authorized under s.
822373.503, subsequent to December 31, 1987, including the purposes
823of certifying the millage rate for fiscal year 1988-1989,
824pursuant to chapter 200, said millage rate shall be levied
825retroactive to January 1, 1988.
826     (9)  At 11:59 p.m. on December 31, 1976, a portion of the
827Big Cypress Basin of the Ridge and Lower Gulf Coast District
828which is being annexed into the South Florida Water Management
829District by change of boundaries pursuant to chapter 76-243,
830Laws of Florida, shall be formed into a subdistrict or basin of
831the South Florida Water Management District. Such portion shall
832be designated as the Big Cypress Basin. On or before December
83331, 1976, the Governor shall appoint not fewer than five persons
834residing in the area to serve as members of the governing board
835of the basin, effective at the time of transfer and subject to
836confirmation by the Senate as provided in subsection (4).
837     (a)  The initial boundaries of the Big Cypress Basin shall
838be established by resolution of the governing board of Central
839and Southern Florida Flood Control District, after notice and
840hearing, and generally shall encompass the Big Cypress Swamp and
841southwestern coastal area hydrologic cataloging unit, as
842indicated on River Basin and Hydrologic Unit Map of
843Florida--1975, Florida Department of Natural Resources, Bureau
844of Geology Map Series No. 72.
845     (b)  If the governing board shall fail to establish the
846initial boundaries on or before December 31, 1976, the initial
847boundaries shall be the same boundaries as described for the Big
848Cypress Basin of the Ridge and Lower Gulf Coast District.
849     (c)  The governing board of the South Florida Water
850Management District subsequently may change the boundaries of
851the basin, but may not abolish the basin.
852     (10)  At 11:59 p.m. on December 31, 1976, the entire area
853of the South Florida Water Management District, including all
854areas being annexed into the district pursuant to chapter 76-
855243, Laws of Florida, but less those areas in the Big Cypress
856Basin, shall be formed into a subdistrict or basin of the South
857Florida Water Management District. Such area shall be designated
858as the Okeechobee Basin.
859     (a)  The governing board of the South Florida Water
860Management District shall also serve as the governing board of
861the Okeechobee Basin.
862     (b)  The governing board of the South Florida Water
863Management District may change the boundaries of the Okeechobee
864Basin or may subdivide the basin into smaller basins to be
865governed by basin boards to be appointed by the Governor,
866subject to confirmation by the Senate as provided in subsection
867(4). However, the basin may not be enlarged to include the area
868included within the initial boundaries of the Big Cypress Basin.
869     (c)  The local effort required in connection with
870construction, operation, and maintenance of the cooperative
871federal project referred to as the Central and Southern Florida
872Flood Control Project, which remains after the upper St. Johns
873portion is transferred to the St. Johns River Water Management
874District, shall be funded by tax levies on all taxable property
875within the Okeechobee Basin. In the event the Okeechobee Basin
876is subdivided into smaller basins, as authorized in paragraph
877(b), the governing board shall ascertain the equitable pro rata
878share for each smaller basin and charge back such share so as to
879ensure that the portion of the Central and Southern Florida
880Flood Control Project remaining in the South Florida Water
881Management District shall continue to be funded on an equal
882basis throughout the entire Okeechobee Basin as initially
883described on December 31, 1976.
884     Section 3.  Section 373.0695, Florida Statutes, is
885reenacted to read:
886     373.0695  Duties of basin boards; authorized
887expenditures.--
888     (1)  The various boards shall be responsible for
889discharging the following described functions in their
890respective basins:
891     (a)  The preparation of engineering plans for development
892of the water resources of the basin and the conduct of public
893hearings on such plans.
894     (b)  The development and preparation of overall basin plan
895of secondary water control facilities for the guidance of
896subdrainage districts and private land owners in the development
897of their respective systems of water control which will be
898connected to the primary works of the basin to complement the
899engineering plan of primary works for the basin.
900     (c)  The preparation of the annual budget for the basin and
901the submission of such budget to the governing board of the
902district for inclusion in the district budget.
903     (d)  The consideration and prior approval of final
904construction plans of the district for works to be constructed
905in the basin.
906     (e)  The administration of the affairs of the basin.
907     (f)  Planning for and, upon request by a county,
908municipality, private utility, or regional water supply
909authority, providing water supply and transmission facilities
910for the purpose of assisting such counties, municipalities,
911private utilities, or regional water supply authorities within
912or serving the basin.
913     (2)  Basin board moneys shall be utilized for:
914     (a)  Engineering studies of works of the basin.
915     (b)  Payment for the preparation of final plans and
916specifications for construction of basin works executed by the
917district.
918     (c)  Payment of costs of construction of works of the basin
919executed by the district.
920     (d)  Payment for maintenance and operation of basin works
921as carried out by the district.
922     (e)  Administrative and regulatory activities of the basin.
923     (f)  Payment for real property interests for works of the
924basin.
925     (g)  Payment of costs of road, bridge, railroad, and
926utilities modifications and changes resulting from basin works.
927     (3)  The works of the basin shall be those adopted by the
928respective basin boards. Such works may be adopted jointly with
929other basins and may be within or without the area of the basin.
930     (4)  In the exercise of the duties and powers granted
931herein, the basin boards shall be subject to all the limitations
932and restrictions imposed on the water management districts in s.
933373.1961.
934     Section 4.  Section 373.073, Florida Statutes, is reenacted
935and amended to read:
936     373.073  Governing board.--
937     (1)(a)  The governing board of each water management
938district shall be composed of 9 members who shall reside within
939the district, except that the Southwest Florida Water Management
940District shall be composed of 13 members who shall reside within
941the district. Members of the governing boards shall be nominated
942by the Florida Public Service Nominating Council created in s.
943350.031 and appointed by the Governor, subject to confirmation
944by the Senate pursuant to subsection (5) at the next regular
945session of the Legislature, and the refusal or failure of the
946Senate to confirm an appointment creates a vacancy in the office
947to which the appointment was made. The term of office for a
948governing board member is 4 years and commences on June March 2
949of the year in which the appointment is confirmed made and
950terminates on June March 1 of the fourth calendar year of the
951term or may continue until a successor is appointed, but not
952more than 180 days. Terms of office of governing board members
953shall be staggered to help maintain consistency and continuity
954in the exercise of governing board duties and to minimize
955disruption in district operations.
956     (b)  Commencing January 1, 1999, the Governor shall appoint
957the following number of governing board members in each year of
958the Governor's 4-year term of office:
959     1.  In the first year of the Governor's term of office, the
960Governor shall appoint three members to the governing board of
961each district.
962     2.  In the second year of the Governor's term of office,
963the Governor shall appoint three members to the governing board
964of the Southwest Florida Water Management District and two
965members to the governing board of each other district.
966     3.  In the third year of the Governor's term of office, the
967Governor shall appoint three members to the governing board of
968the Southwest Florida Water Management District and two members
969to the governing board of each other district.
970     4.  In the fourth year of the Governor's term of office,
971the Governor shall appoint two members to the governing board of
972each district.
973
974For any governing board vacancy that occurs before the date
975scheduled for the office to be filled under this paragraph, the
976nominating council shall nominate and the Governor shall appoint
977a person meeting residency requirements of subsection (2) for a
978term that will expire on the date scheduled for the term of that
979office to terminate under this subsection. In addition to the
980residency requirements for the governing boards as provided by
981subsection (2), the Governor shall consider appointing governing
982board members to represent an equitable cross-section of
983regional interests and technical expertise.
984     (2)  A person may not be nominated to serve as a member of
985a water management district governing board until the nominating
986council has determined that the person has Membership on
987governing boards shall be selected from candidates who have
988significant experience in one or more of the following areas,
989including, but not limited to: agriculture, the development
990industry, local government, government-owned or privately owned
991water utilities, law, civil engineering, environmental science,
992hydrology, accounting, or financial businesses. The council
993shall nominate appointees to represent an equitable cross-
994section of regional interests and technical expertise.
995Recommendations of the nominating council shall be nonpartisan.
996Notwithstanding the provisions of any other general or special
997law to the contrary, vacancies in the governing boards of the
998water management districts shall be filled according to the
999following residency requirements, representing areas designated
1000by the United States Water Resources Council in United States
1001Geological Survey, River Basin and Hydrological Unit Map of
1002Florida--1975, Map Series No. 72:
1003     (a)  Northwest Florida Water Management District:
1004     1.  One member shall reside in the area generally
1005designated as the "Perdido River Basin-Perdido Bay Coastal Area-
1006Lower Conecuh River-Escambia River Basin" hydrologic units and
1007that portion of the "Escambia Bay Coastal Area" hydrologic unit
1008which lies west of Pensacola Bay and Escambia Bay.
1009     2.  One member shall reside in the area generally
1010designated as the "Blackwater River Basin-Yellow River Basin-
1011Choctawhatchee Bay Coastal Area" hydrologic units and that
1012portion of the "Escambia Bay Coastal Area" hydrologic unit which
1013lies east of Pensacola Bay and Escambia Bay.
1014     3.  One member shall reside in the area generally
1015designated as the "Choctawhatchee River Basin-St. Andrews Bay
1016Coastal Area" hydrologic units.
1017     4.  One member shall reside in the area generally
1018designated as the "Lower Chattahoochee-Apalachicola River-
1019Chipola River Basin-Coastal Area between Ochlockonee River
1020Apalachicola Rivers-Apalachicola Bay coastal area and offshore
1021islands" hydrologic units.
1022     5.  One member shall reside in the area generally
1023designated as the "Ochlockonee River Basin-St. Marks and Wakulla
1024Rivers and coastal area between Aucilla and Ochlockonee River
1025Basin" hydrologic units.
1026     6.  Four members shall be appointed at large, except that
1027no county shall have more than two members on the governing
1028board.
1029     (b)  Suwannee River Water Management District:
1030     1.  One member shall reside in the area generally
1031designated as the "Aucilla River Basin" hydrologic unit.
1032     2.  One member shall reside in the area generally
1033designated as the "Coastal Area between Suwannee and Aucilla
1034Rivers" hydrologic unit.
1035     3.  One member shall reside in the area generally
1036designated as the "Withlacoochee River Basin-Alapaha River
1037Basin-Suwannee River Basin above the Withlacoochee River"
1038hydrologic units.
1039     4.  One member shall reside in the area generally
1040designated as the "Suwannee River Basin below the Withlacoochee
1041River excluding the Santa Fe River Basin" hydrologic unit.
1042     5.  One member shall reside in the area generally
1043designated as the "Santa Fe Basin-Waccasassa River and coastal
1044area between Withlacoochee and Suwannee River" hydrologic units.
1045     6.  Four members shall be appointed at large, except that
1046no county shall have more than two members on the governing
1047board.
1048     (c)  St. Johns River Water Management District:
1049     1.  One member shall reside in the area generally
1050designated as the "St. Marys River Basin-Coastal area between
1051St. Marys and St. Johns Rivers" hydrologic units.
1052     2.  One member shall reside in the area generally
1053designated as the "St. Johns River Basin below Oklawaha River-
1054Coastal area between the St. Johns River and Ponce de Leon
1055Inlet" hydrologic units.
1056     3.  One member shall reside in the area generally
1057designated as the "Oklawaha River Basin" hydrologic unit.
1058     4.  One member shall reside in the area generally
1059designated as the "St. Johns River Basin above the Oklawaha
1060River" hydrologic unit.
1061     5.  One member shall reside in the area generally
1062designated as the "Coastal area between Ponce de Leon Inlet and
1063Sebastian Inlet-Coastal area Sebastian Inlet to St. Lucie River"
1064hydrologic units.
1065     6.  Four members shall be appointed at large, except that
1066no county shall have more than two members on the governing
1067board.
1068     (d)  South Florida Water Management District:
1069     1.  Two members shall reside in Dade County.
1070     2.  One member shall reside in Broward County.
1071     3.  One member shall reside in Palm Beach County.
1072     4.  One member shall reside in Collier County, Lee County,
1073Hendry County, or Charlotte County.
1074     5.  One member shall reside in Glades County, Okeechobee
1075County, Highlands County, Polk County, Orange County, or Osceola
1076County.
1077     6.  Two members, appointed at large, shall reside in an
1078area consisting of St. Lucie, Martin, Palm Beach, Broward, Dade,
1079and Monroe Counties.
1080     7.  One member, appointed at large, shall reside in an area
1081consisting of Collier, Lee, Charlotte, Hendry, Glades, Osceola,
1082Okeechobee, Polk, Highlands, and Orange Counties.
1083     8.  No county shall have more than three members on the
1084governing board.
1085     (e)  Southwest Florida Water Management District:
1086     1.  Two members shall reside in Hillsborough County.
1087     2.  One member shall reside in the area consisting of
1088Hillsborough and Pinellas Counties.
1089     3.  Two members shall reside in Pinellas County.
1090     4.  One member shall reside in Manatee County.
1091     5.  Two members shall reside in Polk County.
1092     6.  One member shall reside in Pasco County.
1093     7.  One member shall be appointed at large from Levy,
1094Citrus, Sumter, and Lake Counties.
1095     8.  One member shall be appointed at large from Hardee,
1096DeSoto, and Highlands Counties.
1097     9.  One member shall be appointed at large from Marion and
1098Hernando Counties.
1099     10.  One member shall be appointed at large from Sarasota
1100and Charlotte Counties.
1101     (3)  It is the responsibility of the nominating council to
1102nominate to the Governor three persons for each vacancy on the
1103governing boards of any of the five water management districts.
1104The council shall submit the recommendations to the Governor by
1105December 31 for the seats of those governing board members whose
1106terms are to expire the following calendar year, or within 90
1107days after a vacancy occurs for any reason other than the
1108expiration of the term.
1109     (4)  The Governor shall select from the list of nominees
1110provided by the nominating council. The Governor shall fill a
1111vacancy occurring on the governing board of a water management
1112district by appointment of one of the applicants nominated by
1113the council only after a background investigation of such
1114applicant has been conducted by the Department of Law
1115Enforcement. If the Governor has not made an appointment within
111660 consecutive calendar days after the receipt of the
1117recommendations, the council shall initiate, in accordance with
1118this section, the nominating process within 30 days.
1119     (5)  Each appointment to the governing board of a water
1120management district shall be subject to confirmation by the
1121Senate during the next regular session after the vacancy occurs.
1122If the Senate refuses to confirm or fails to consider the
1123appointment of the Governor, the nominating council shall
1124initiate, in accordance with this section, the nominating
1125process within 30 days. Under no circumstances may an appointee
1126serve on the governing board of a water management district
1127until confirmed by the Senate.
1128     Section 5.  Subsection (7) of section 373.079, Florida
1129Statutes, is amended to read:
1130     373.079  Members of governing board; oath of office;
1131staff.--
1132     (7)  The governing board shall meet at least once a month
1133and upon call of the chair. The governing board, a basin board,
1134a committee, or an advisory board may conduct meetings by means
1135of communications media technology as provided in the uniform
1136rules of procedure adopted pursuant to s. 120.54.
1137     Section 6.  Section 373.083, Florida Statutes, is reenacted
1138to read:
1139     373.083  General powers and duties of the governing
1140board.--In addition to other powers and duties allowed it by
1141law, the governing board is authorized to:
1142     (1)  Contract with public agencies, private corporations,
1143or other persons; sue and be sued; and appoint and remove agents
1144and employees, including specialists and consultants.
1145     (2)  Issue orders to implement or enforce any of the
1146provisions of this chapter or regulations thereunder.
1147     (3)  Make surveys and investigations of the water supply
1148and resources of the district and cooperate with other
1149governmental agencies in similar activities.
1150     (4)  Solicit and accept donations or grants of funds or
1151services from both public and private sources for the planning
1152and implementation of district undertakings and delegations,
1153including, but not limited to, projects, programs, works, and
1154studies.
1155     (5)  Execute any of the powers, duties, and functions
1156vested in the governing board through a member or members
1157thereof, the executive director, or other district staff as
1158designated by the governing board. The governing board may
1159establish the scope and terms of any delegation. However, if the
1160governing board delegates the authority to take final action on
1161permit applications under part II or part IV, or petitions for
1162variances or waivers of permitting requirements under part II or
1163part IV, the governing board shall provide a process for
1164referring any denial of such application or petition to the
1165governing board to take final action. The authority in this
1166subsection is supplemental to any other provision of this
1167chapter granting authority to the governing board to delegate
1168specific powers, duties, or functions.
1169     Section 7.  Subsection (3) of section 373.323, Florida
1170Statutes, is amended to read:
1171     373.323  Licensure of water well contractors; application,
1172qualifications, and examinations; equipment identification.--
1173     (3)  An applicant who meets the following requirements
1174shall be entitled to take the water well contractor licensure
1175examination to practice water well contracting:
1176     (a)  Is at least 18 years of age.
1177     (b)  Has at least 2 years of experience in constructing,
1178repairing, or abandoning water wells. Satisfactory proof of such
1179experience shall be demonstrated by providing:
1180     1.  Evidence of the length of time the applicant has been
1181engaged in the business of the construction, abandonment, and
1182repair of water wells as a major activity, as attested to by
1183three letters from any of the following persons:
1184     a.  Water well contractors.
1185     b.  Water well drillers.
1186     c.  Water well parts and equipment vendors.
1187     d.  Water well inspectors employed by a governmental
1188agency.
1189     2.  A list of at least 10 water wells that the applicant
1190has constructed, repaired, or abandoned, which includes the
1191following information:
1192     a.  The name and address of the owner or owners of each
1193well.
1194     b.  The location, primary use, and approximate depth and
1195diameter of each well that the applicant has constructed,
1196repaired, or abandoned.
1197     c.  The approximate date the construction, repair, or
1198abandonment of each well was completed.
1199     3.  All listed wells must have been constructed, repaired,
1200or abandoned within 5 years immediately preceding the filing of
1201the license application. At least 7 of the 10 water wells must
1202have been constructed by the applicant, as defined in s.
1203373.303(2).
1204     (c)  Has completed the application form and remitted a
1205nonrefundable application fee.
1206     Section 8.  Paragraph (a) of subsection (3) of section
1207373.503, Florida Statutes, is amended, subsection (5) is
1208renumbered as subsection (6), and a new subsection (5) is added
1209to that section, to read:
1210     373.503  Manner of taxation.--
1211     (3)(a)  Subject to annual authorization by the Legislature
1212to levy ad valorem taxes under subsection (5), the districts may
1213levy ad valorem taxes on property within the district solely for
1214the purposes of this chapter and of chapter 25270, 1949, Laws of
1215Florida, as amended, and chapter 61-691, Laws of Florida, as
1216amended. The authority to levy ad valorem taxes as provided in
1217this act shall commence with the year 1977. However, the taxes
1218levied for 1977 by the governing boards pursuant to this section
1219shall be prorated to ensure that no such taxes will be levied
1220for the first 4 days of the tax year, which days will fall prior
1221to the effective date of the amendment to s. 9(b), Art. VII of
1222the State Constitution, which was approved March 9, 1976. When
1223appropriate, taxes levied by each governing board may be
1224separated by the governing board into a millage necessary for
1225the purposes of the district and a millage necessary for
1226financing basin functions specified in s. 373.0695. Beginning
1227with the taxing year 1977, and Notwithstanding the provisions of
1228any other general or special law to the contrary and subject to
1229annual authorization by the Legislature to levy ad valorem taxes
1230under subsection (5), the maximum total millage rate for
1231district and basin purposes shall be:
1232     1.  Northwest Florida Water Management District: 0.05 mill.
1233     2.  Suwannee River Water Management District: 0.75 mill.
1234     3.  St. Johns River Water Management District: 0.6 mill.
1235     4.  Southwest Florida Water Management District: 1.0 mill.
1236     5.  South Florida Water Management District: 0.80 mill.
1237     (5)  To ensure that the taxes authorized by this chapter
1238continue to be in proportion to the benefits derived by the
1239several parcels of real estate within the districts, the
1240Legislature shall annually review the authorized millage rate
1241for each district and annually set the maximum amount of revenue
1242authorized to be raised by each district from the taxes
1243authorized by this chapter. However, if the annual maximum
1244amount of revenue authorized to be raised by each district is
1245not set by the Legislature on or before July 1 of each year,
1246each district is authorized to raise the amount of revenue
1247authorized by the Legislature in the preceding fiscal year and
1248adjusted by the percentage change in the Consumer Price Index
1249for the preceding fiscal year.
1250     Section 9.  Subsections (1) and (2) and paragraphs (c),
1251(e), and (f) of subsection (5) of section 373.536, Florida
1252Statutes, are amended, to read:
1253     373.536  District budget and hearing thereon.--
1254     (1)  FISCAL YEAR.--The fiscal year of districts created
1255under the provisions of this chapter shall extend from July
1256October 1 of one year through June September 30 of the following
1257year.
1258     (2)  BUDGET SUBMITTAL.--The budget officer of the district
1259shall, on or before July 15 of each year, submit for
1260consideration by the governing board of the district a tentative
1261budget for the district covering its proposed operations and
1262funding requirements for the ensuing fiscal year.
1263     (5)  TENTATIVE BUDGET CONTENTS AND SUBMISSION; REVIEW AND
1264APPROVAL.--
1265     (c)  Each water management district shall, by February
1266August 1 of each year, submit for review a tentative budget to
1267the Governor, the President of the Senate, the Speaker of the
1268House of Representatives, the chairs of all legislative
1269committees and subcommittees with substantive or fiscal
1270jurisdiction over water management districts, as determined by
1271the President of the Senate or the Speaker of the House of
1272Representatives as applicable, the secretary of the department,
1273and the governing body of each county in which the district has
1274jurisdiction or derives any funds for the operations of the
1275district.
1276     (e)  By September 5 of the year in which the budget is
1277submitted, the House and Senate appropriations chairs may
1278transmit to each district comments and objections to the
1279proposed budgets. Each district governing board shall include a
1280response to such comments and objections in the record of the
1281governing board meeting where final adoption of the budget takes
1282place, and the record of this meeting shall be transmitted to
1283the Executive Office of the Governor, the department, and the
1284chairs of the House and Senate appropriations committees.
1285     (e)(f)  The Executive Office of the Governor shall
1286annually, on or before September December 15, file with the
1287Legislature a report that summarizes its review of the water
1288management districts' tentative budgets and displays the adopted
1289budget allocations by program area. The report must identify the
1290districts that are not in compliance with the reporting
1291requirements of this section. State funds shall be withheld from
1292a water management district that fails to comply with these
1293reporting requirements.
1294     Section 10.  For the 2008-2009 and 2009-2010 fiscal years,
1295notwithstanding any law to the contrary, the water management
1296districts are directed to budget and plan for their fiscal
1297management to conform to the provisions of this act.
1298     Section 11.  This act shall take effect July 1, 2008.
