The Committee on Judiciary (Fasano) recommended the following

amendment:

     Senate Amendment (with title amendment)

     Delete lines 18-23

and insert:

who is not engaged in the practice of law and either:

     (a) Has failed to win reelection or be retained after more

9

than 12 years of service as a justice or judge; or not been

10

defeated in seeking reelection to, or has not failed to be

11

retained in seeking retention in, his or her last judicial office

12

or was not defeated when last seeking election to judicial

13

office; and

14

     (b) Has served at least one complete term as a justice or

15

judge and has chosen not to stand for retention or reelection at

16

the conclusion of the latest term is not engaged in the practice

17

of law.
