An act relating to retired justices and judges; amending

3

s. 25.073, F.S.; providing that a former justice or judge

4

may be qualified to serve as a retired justice or judge

5

under certain conditions; providing circumstances under

6

which such justice or judge is excluded from serving as a

7

retired justice or judge; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Present subsections (2) and (3) of section

12

25.073, Florida Statutes, are renumbered as subsections (3) and

13

(4), respectively, and a new subsection (2) is added to that

14

section, to read:

15

     25.073  Retired justices or judges assigned to temporary

16

duty; additional compensation; appropriation.--

17

     (2) Notwithstanding subsection (1), a former justice or

18

judge who has failed to win reelection or be retained after more

19

than 12 years of service as a justice or judge, or has served at

20

least one complete term as a justice or judge and has chosen not

21

to stand for retention or reelection at the conclusion of the

22

latest term, may be qualified to serve as a retired justice or

23

judge unless:

24

     (a) Such former justice or judge has been reprimanded,

25

fined, suspended, or disciplined by the Florida Supreme Court for

26

violations of the Florida Code of Judicial Conduct or the rules

27

regulating The Florida Bar;

28

     (b) The Judicial Qualifications Commission has brought

29

charges against such former justice or judge which were not

30

dismissed, or such former justice or judge was not exonerated of

31

all such charges; or

32

     (c) Any party objects to the assignment of such former

33

justice or judge when such former justice or judge is to preside

34

over a civil case, including any appeal of a civil case.

35

     Section 2.  This act shall take effect July 1, 2008.
