An act relating to sexual activities involving animals;

creating s. 828.126, F.S.; providing definitions;

4

prohibiting knowing sexual conduct or sexual contact with

5

an animal; prohibiting specified related activities;

6

providing penalties; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Section 828.126, Florida Statutes, is created to

11

read:

12

     828.126 Sexual activities involving animals.--

13

     (1) For purposes of this section, the term:

14

     (a) "Sexual conduct" means any touching or fondling by a

15

person, either directly or through clothing, of the sex organs or

16

anus of an animal or any transfer or transmission of semen by the

17

person upon any part of the animal for the purpose of sexual

18

gratification or arousal of the person.

     (b) "Sexual contact" means any contact, however slight,

20

between the mouth, sex organ, or anus of a person and the sex

21

organ or anus of an animal, or any penetration, however slight,

22

of any part of the body of the person into the sex organ or anus

23

of an animal, or any penetration of the sex organ or anus of the

24

person into the mouth of the animal, for the purpose of sexual

25

gratification or sexual arousal of the person.

     (c) "Photographs" or "films" means the making of a

27

photograph, motion picture film, videotape, digital image, or any

28

other visual recording.

     (2) A person who:

30

     (a) Knowingly engages in any sexual conduct or sexual

31

contact with an animal;

32

     (b) Knowingly causes, aids, or abets another person to

33

engage in any sexual conduct or sexual contact with an animal;

34

     (c) Knowingly permits any sexual conduct or sexual contact

35

with an animal to be conducted on any premises under his or her

36

charge or control;

     (d) Knowingly engages in organizing, promoting, conducting,

38

advertising, aiding, abetting, participating in as an observer,

39

or performing any service in the furtherance of an act involving

40

any sexual conduct or sexual contact with an animal for a

41

commercial or recreational purpose; or

     (e) Knowingly photographs or films, for the purposes of

43

sexual gratification, a person engaged in any sexual conduct or

44

sexual contact with an animal, or knowingly sells or transmits

45

such a photograph or film

commits a felony of the first degree, punishable as provided in

48

s. 775.082, s. 775.083, or s. 775.084.

     Section 2.  This act shall take effect October 1, 2008.
