The Committee on Health Regulation (Atwater) recommended the

following amendment:

     (2)(a) Any health care practitioner as defined in s.

9

456.001 physician licensed under chapter 458, osteopathic

10

physician licensed under chapter 459, chiropractic physician

11

licensed under chapter 460, or other practitioner licensed under

12

the laws of this state who knowingly and willfully assists,

13

conspires with, or urges any insured party to fraudulently

14

violate any of the provisions of this section or part XI of

15

chapter 627, or any person who, due to such assistance,

16

conspiracy, or urging by the health care said physician,

17

osteopathic physician, chiropractic physician, or practitioner,

18

knowingly and willfully benefits from the proceeds derived from

19

the use of such fraud, commits insurance fraud, punishable as

20

provided in subsection (11). If In the event that a health care

21

physician, osteopathic physician, chiropractic physician, or

22

practitioner is adjudicated guilty of a violation of this

23

section, the appropriate board, or the Department of Health if

24

there is no board, Board of Medicine as set forth in chapter 458,

25

the Board of Osteopathic Medicine as set forth in chapter 459,

26

the Board of Chiropractic Medicine as set forth in chapter 460,

27

or other appropriate licensing authority shall hold an

28

administrative hearing to consider the imposition of

29

administrative sanctions as provided by law against the health

30

care said physician, osteopathic physician, chiropractic

31

physician, or practitioner.

     (b) If a health care practitioner as defined in s. 456.001

33

licensed under the laws of this state is convicted of insurance

34

fraud involving a claim for personal injury protection benefits

35

as required by s. 627.736, the appropriate board, or the

36

Department of Health if there is no board, shall, in addition to

37

any other punishment less than revocation or relinquishment of

38

the license, suspend the license of such health care practitioner

39

for 12 months.
