5 | United States Environmental Protection Agency. A county may not |
6 | impose an assessment or fee for stormwater management on land |
7 | classified as agricultural land pursuant to s. 193.461 if the |
8 | agricultural operation has an agricultural discharge permit or |
9 | an environmental resource permit or implements best management |
10 | practices developed by the Department of Environmental |
11 | Protection, the Department of Agriculture and Consumer Services, |
12 | or a water management district pursuant to s. 403.067 and |
13 | adopted under chapter 120 as part of a statewide or regional |
14 | program, except under the following conditions: the ordinance |
15 | imposing the assessment or fee is adopted by a county required |
16 | to obtain a municipal separate storm sewer system permit; |
17 | discharges from the agricultural lands contribute to the |
18 | municipal separate stormwater system permitted facilities; and |
19 | the ordinance provides credits for the water quality and flood |
20 | control provided by implementation of stormwater control |
21 | measures against the fee or assessment charged for stormwater |
22 | management. A local government shall not impose a stormwater |
23 | management fee or assessment on forest lands or unimproved |
24 | pasture. |
