An act relating to the excavation and demolition

notification system; amending s. 556.105, F.S.;

prohibiting charging a member operator for the costs or

5

expenses associated with compliance with system procedures

6

by an excavator; prohibiting charging an excavator for the

7

costs or expenses associated with compliance with system

8

procedures by a member operator; providing for

9

application; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Subsection (13) is added to section 556.105,

14

Florida Statutes, to read:

15

     556.105  Procedures.--

16

     (13) Any costs or expenses associated with compliance by an

17

excavator with the requirements in this section applicable to

18

excavators shall not be charged to any member operator. Any costs

19

or expenses associated with compliance by a member operator with

20

the requirements in this section applicable to member operators

21

shall not be charged to any excavator. No person shall charge the

22

costs or expenses prohibited by this subsection after the

23

effective date of this act. This subsection shall not excuse a

24

member operator or excavator from liability for any damage or

25

injury for which it would be responsible under applicable law.

     Section 2.  This act shall take effect upon becoming a law.
