| 3 | officers; creating s. 493.6307, F.S.; permitting certain | 
| 4 | licensed security officers to detain certain alleged | 
| 5 | offenders in a reasonable manner until the arrival of law | 
| 6 | enforcement officers; requiring transfer of alleged | 
| 7 | offenders to officers' custody; providing immunity from | 
| 8 | specified liability for such detentions if done in | 
| 9 | compliance with specified provisions; providing an | 
| 10 | effective date. |

| 12 | Be It Enacted by the Legislature of the State of Florida: | 
| 13 | 
 | 
| 14 | Section 1.  Section 493.6307, Florida Statutes, is created | 
| 15 | to read: | 
| 16 | 493.6307  Detention of suspects.-- | 
| 17 | (1)  A Class "D" or Class "M" licensee performing duties | 
| 18 | regulated under this chapter who has probable cause to believe | 
| 19 | that a felony or misdemeanor has been committed may take the | 
| 20 | alleged offender into custody and detain the alleged offender in | 
| 21 | a reasonable manner until the arrival of a law enforcement | 
| 22 | officer. A law enforcement officer shall be called to the scene | 
| 23 | immediately after the alleged offender has been taken into | 
| 24 | custody, and the alleged offender shall be transferred to the | 
| 25 | officer's custody upon the officer's arrival. | 
| 26 | (2)  A Class "D" or Class "M" licensee who takes a person | 
| 27 | into custody in compliance with subsection (1) shall not be | 
| 28 | criminally or civilly liable for false arrest or false | 
| 29 | imprisonment. | 
| 30 | Section 2.  This act shall take effect July 1, 2008. |
