2An act relating to the display of flags; amending s.
3720.304, F.S.; authorizing homeowners to display certain
4flags in a specified manner; providing an effective date.

6Be It Enacted by the Legislature of the State of Florida:

8     Section 1.  Subsection (2) of section 720.304, Florida
9Statutes, is amended to read:
10     720.304  Right of owners to peaceably assemble; display of
11flag; SLAPP suits prohibited.--
12     (2)(a)  Any homeowner may display one official portable,
13removable United States flag, not larger than 4 feet by 6 feet,
14or official flag of the State of Florida in a respectful manner
15from a freestanding flagpole not to exceed 20 feet in height in
16the front, rear, or side yard of the property, and on Armed
17Forces Day, Memorial Day, Flag Day, Independence Day, and
18Veterans Day may display in a respectful manner portable,
19removable official flags, not larger than 41/2 feet by 6 feet,
20which represent the United States Army, Navy, Air Force, Marine
21Corps, or Coast Guard, regardless of any declaration rules or
22requirements dealing with flags or decorations.
23     (b)  In addition to the display of the United States flag
24authorized pursuant to paragraph (a), any homeowner may display
25one official flag of the State of Florida, a flag that
26represents the United States Army, Navy, Air Force, Marine
27Corps, or Coast Guard, or the POW-MIA flag in a respectful
28manner below the United States flag from the freestanding
29flagpole authorized pursuant to paragraph (a). The additional
30flag authorized pursuant to this paragraph may not be larger
31than 3 feet by 5 feet.
32     (c)  The provisions of this subsection shall not apply to
33condominiums or any property that is community owned.
34     Section 2.  This act shall take effect July 1, 2008.
