A bill to be entitled
2An act relating to protection of ocean lifeguards;
3amending s. 784.07, F.S.; providing a definition;
4providing enhanced penalties for an assault or battery on
5an ocean lifeguard while he or she is engaged in the
6lawful performance of his or her duties; amending ss.
7435.04, 901.15, 943.051, and 985.11, F.S.; conforming
8provisions; amending s. 921.0022, F.S., and reenacting
9paragraph (3)(d), relating the offense severity ranking
10chart, to conform; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Paragraph (e) is added to subsection (1) of
15section 784.07, Florida Statutes, subsection (2) of that section
16is amended, and subsection (3) of that section is reenacted, to
17read:
18     784.07  Assault or battery of law enforcement officers,
19firefighters, emergency medical care providers, public transit
20employees or agents, or other specified officers;
21reclassification of offenses; minimum sentences.--
22     (1)  As used in this section, the term:
23     (e)  "Ocean lifeguard" means a lifeguard employed along the
24coastal or intracoastal beaches and shores of the state to help
25prevent injury or drowning of persons.
26     (2)  Whenever any person is charged with knowingly
27committing an assault or battery upon a law enforcement officer,
28a firefighter, an emergency medical care provider, a traffic
29accident investigation officer as described in s. 316.640, a
30nonsworn law enforcement agency employee who is certified as an
31agency inspector, blood alcohol analyst, or a breath test
32operator while such employee is in uniform and engaged in
33processing, testing, evaluating, analyzing, or transporting a
34person who is detained or under arrest for DUI, a traffic
35infraction enforcement officer as described in s. 316.640, a
36parking enforcement specialist as defined in s. 316.640, a
37person licensed as a security officer as defined in s. 493.6101
38and wearing a uniform that bears at least one patch or emblem
39that is visible at all times that clearly identifies the
40employing agency and that clearly identifies the person as a
41licensed security officer, or a security officer employed by the
42board of trustees of a community college, or an ocean lifeguard
43while the officer, firefighter, emergency medical care provider,
44intake officer, traffic accident investigation officer, traffic
45infraction enforcement officer, inspector, analyst, operator,
46parking enforcement specialist, public transit employee or
47agent, or security officer, or ocean lifeguard is engaged in the
48lawful performance of his or her duties, the offense for which
49the person is charged shall be reclassified as follows:
50     (a)  In the case of assault, from a misdemeanor of the
51second degree to a misdemeanor of the first degree.
52     (b)  In the case of battery, from a misdemeanor of the
53first degree to a felony of the third degree.
54     (c)  In the case of aggravated assault, from a felony of
55the third degree to a felony of the second degree.
56Notwithstanding any other provision of law, any person convicted
57of aggravated assault upon a law enforcement officer shall be
58sentenced to a minimum term of imprisonment of 3 years.
59     (d)  In the case of aggravated battery, from a felony of
60the second degree to a felony of the first degree.
61Notwithstanding any other provision of law, any person convicted
62of aggravated battery of a law enforcement officer shall be
63sentenced to a minimum term of imprisonment of 5 years.
64     (3)  Any person who is convicted of a battery under
65paragraph (2)(b) and, during the commission of the offense, such
66person possessed:
67     (a)  A "firearm" or "destructive device" as those terms are
68defined in s. 790.001, shall be sentenced to a minimum term of
69imprisonment of 3 years.
70     (b)  A semiautomatic firearm and its high-capacity
71detachable box magazine, as defined in s. 775.087(3), or a
72machine gun as defined in s. 790.001, shall be sentenced to a
73minimum term of imprisonment of 8 years.

75Notwithstanding s. 948.01, adjudication of guilt or imposition
76of sentence shall not be suspended, deferred, or withheld, and
77the defendant is not eligible for statutory gain-time under s.
78944.275 or any form of discretionary early release, other than
79pardon or executive clemency, or conditional medical release
80under s. 947.149, prior to serving the minimum sentence.
81     Section 2.  Paragraph (a) of subsection (3) of section
82435.04, Florida Statutes, is amended to read:
83     435.04  Level 2 screening standards.--
84     (3)  The security background investigations conducted under
85this section for employees of the Department of Juvenile Justice
86must ensure that no persons subject to the provisions of this
87section have been found guilty of, regardless of adjudication,
88or entered a plea of nolo contendere or guilty to, any offense
89prohibited under any of the following provisions of the Florida
90Statutes or under any similar statute of another jurisdiction:
91     (a)  Section 784.07, relating to assault or battery of law
92enforcement officers, firefighters, emergency medical care
93providers, public transit employees or agents, or other
94specified persons officers.

96The Department of Juvenile Justice may not remove a
97disqualification from employment or grant an exemption to any
98person who is disqualified under this section for any offense
99disposed of during the most recent 7-year period.
100     Section 3.  Subsection (15) of section 901.15, Florida
101Statutes, is amended to read:
102     901.15  When arrest by officer without warrant is
103lawful.--A law enforcement officer may arrest a person without a
104warrant when:
105     (15)  There is probable cause to believe that the person
106has committed assault upon a law enforcement officer, a
107firefighter, an emergency medical care provider, public transit
108employee employees or agent agents, or other specified person
109officers as set forth in s. 784.07 or has committed assault or
110battery upon any employee of a receiving facility as defined in
111s. 394.455 who is engaged in the lawful performance of his or
112her duties.
113     Section 4.  For the purpose of incorporating the amendment
114made by this act to section 784.07, Florida Statutes, in a
115reference thereto, paragraphs (d) of subsection (3) of section
116921.0022, Florida Statutes, is reenacted, and paragraphs (f) and
117(g) of that subsection are amended to read:

350     4.  Unlawful use of destructive devices or bombs, as
351defined in s. 790.1615(1).
352     5.  Negligent treatment of children, as defined in s.
353827.05.
354     6.  Assault or battery on a law enforcement officer, a
355firefighter, or other specified person officers, as defined in
356s. 784.07(2)(a) and (b).
357     7.  Open carrying of a weapon, as defined in s. 790.053.
358     8.  Exposure of sexual organs, as defined in s. 800.03.

373fingerprints shall be submitted to the Department of Law
374Enforcement as provided in s. 943.051(3)(b):
375     1.  Assault, as defined in s. 784.011.
376     2.  Battery, as defined in s. 784.03.

378790.01(1).
379     4.  Unlawful use of destructive devices or bombs, as
380defined in s. 790.1615(1).

382s. 827.05.
383     6.  Assault on a law enforcement officer, a firefighter, or
384other specified person officers, as defined in s. 784.07(2)(a).

397A law enforcement agency may fingerprint and photograph a child
398taken into custody upon probable cause that such child has
399committed any other violation of law, as the agency deems
400appropriate. Such fingerprint records and photographs shall be
401retained by the law enforcement agency in a separate file, and
402these records and all copies thereof must be marked "Juvenile
403Confidential." These records are not available for public
404disclosure and inspection under s. 119.07(1) except as provided
405in ss. 943.053 and 985.04(2), but shall be available to other
406law enforcement agencies, criminal justice agencies, state
407attorneys, the courts, the child, the parents or legal
408custodians of the child, their attorneys, and any other person
409authorized by the court to have access to such records. In
410addition, such records may be submitted to the Department of Law
411Enforcement for inclusion in the state criminal history records
412and used by criminal justice agencies for criminal justice
413purposes. These records may, in the discretion of the court, be
414open to inspection by anyone upon a showing of cause. The
415fingerprint and photograph records shall be produced in the
416court whenever directed by the court. Any photograph taken
417pursuant to this section may be shown by a law enforcement
418officer to any victim or witness of a crime for the purpose of
419identifying the person who committed such crime.
420     Section 7.  This act shall take effect October 1, 2008.
