An act relating to license plates; amending ss. 320.08056

and 320.08058, F.S.; requiring the Department of Highway

4

Safety and Motor Vehicles to create an HIV/AIDS Awareness

5

license plate; providing for the distribution of annual

6

use fees received from the sale of such plates; providing

7

an effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Paragraph (mmm) is added to subsection (4) of

12

section 320.08056, Florida Statutes, to read:

13

     320.08056  Specialty license plates.--

14

     (4)  The following license plate annual use fees shall be

15

collected for the appropriate specialty license plates:

16

     (mmm) HIV/AIDS Awareness license plate, $25.

17

     Section 2.  Subsection (65) is added to section 320.08058,

18

Florida Statutes, to read:

19

     320.08058  Specialty license plates.--

20

     (65) HIV/AIDS AWARENESS LICENSE PLATES.--

     (a) Not withstanding the provisions of s. 320.08053, the

22

department shall develop an HIV/AIDS Awareness license plate as

23

provided in this section. The word "Florida" must appear at the

24

top of the plate and the words "Safety=Life" must appear at the

25

bottom of the plate.

     (b) The annual use fees shall be distributed to nonprofit

27

HIV/AIDS organizations to fund activities to educate persons in

28

this state concerning the need for HIV/AIDS prevention and

29

detection. The Department of Health shall develop a plan to

30

distribute the funds in coordination with its other HIV/AIDS

31

education and prevention activities.

     (c) Up to 10 percent of the proceeds from the annual use

33

fee may be used for marketing the HIV/AIDS awareness license

34

plate and for administrative costs directly related to the

35

management and distribution of the proceeds.

     Section 3.  This act shall take effect July 1, 2008.
