A bill to be entitled

An act relating to teaching hospitals; providing that the
3
establishment of a teaching hospital is exempt from the
4
requirement to obtain a certificate of need from the
5
Agency for Health Care Administration if the hospital is
6
located on property owned or leased by a state university
7
having a medical school that meets certain criteria;
8
providing for such project to receive a letter of
9
exemption upon filing; prohibiting a state university
10
having an accredited medical school from receiving an
11
exemption for more than one project; providing an
12
effective date.

Be It Enacted by the Legislature of the State of Florida:

Section 1. Paragraph (u) is added to subsection (3) of
17
section 408.036, Florida Statutes, to read:

408.036 Projects subject to review; exemptions.--
19
(1) APPLICABILITY.--Unless exempt under subsection (3), all
20
health-care-related projects, as described in paragraphs (a)-(g),
21
are subject to review and must file an application for a
22
certificate of need with the agency. The agency is exclusively
23
responsible for determining whether a health-care-related project
25
(3) EXEMPTIONS.--Upon request, the following projects are
26
subject to exemption from the provisions of subsection (1):

(u) For the establishment of a teaching hospital on real
28
property owned by or leased to the board of trustees of a state
29
university having an accredited medical school that exhibits
30
activity in the area of graduate medical education as reflected
31
by at least seven different graduate medical education programs
32
accredited by the Accreditation Council of Graduate Medical
33
Education and the presence of 100 or more full-time equivalent
34
resident physicians. Upon filing for an exemption under this
35
paragraph, such project shall immediately receive a letter of
36
exemption. However, a state university that has an accredited
37
medical school may not receive a letter of exemption for more
38
than one project described in this paragraph.

Section 2. This act shall take effect July 1, 2008.
