An act relating to health care in medically underserved

areas; amending s. 893.02, F.S.; redefining the term

4

"practitioner" to include an advanced registered nurse

5

practitioner; authorizing an advanced registered nurse

6

practitioner to prescribe certain controlled substances

7

under a protocol with a licensed physician; providing an

8

effective date.

Be It Enacted by the Legislature of the State of Florida:

     Section 1.  Subsection (19) of section 893.02, Florida

13

Statutes, is amended to read:

14

893.02  Definitions.--The following words and phrases as

15

used in this chapter shall have the following meanings, unless

16

the context otherwise requires:

     (19) "Practitioner" means a physician licensed under

18

pursuant to chapter 458, a dentist licensed under pursuant to

19

chapter 466, a veterinarian licensed under pursuant to chapter

20

474, an osteopathic physician licensed under pursuant to chapter

21

459, a naturopath licensed under pursuant to chapter 462, or a

22

podiatric physician licensed under pursuant to chapter 461, or an

23

advanced registered nurse practitioner certified under s. 464.012

24

whose practice is located within a medically underserved area or

25

who provides care to a medically underserved population as

26

designated by the Health Resources and Services Administration of

27

the United States Department of Health and Human Services if

28

provided such practitioner holds a valid federal controlled

29

substance registry number. An advanced registered nurse

30

practitioner certified under s. 464.012 whose practice is located

31

within a medically underserved area or who provides care to a

32

medically underserved population as designated by the Health

33

Resources and Services Administration of the United States

34

Department of Health and Human Services may prescribe substances

35

listed in Schedule II, Schedule III, Schedule IV, or Schedule V

36

of s. 893.03 to the extent authorized by a protocol with a

37

physician licensed under chapter 458 or chapter 459.

     Section 2.  This act shall take effect upon becoming a law.
