A bill to be entitled

An act relating to slot machine gaming; providing a short

3

title; requiring an applicant for a license or license

4

renewal for conducting slot machine gaming to enter into a

5

binding agreement with certain additional pari-mutuel

6

associations governing the payment of purses and other

7

awards on live thoroughbred races conducted at the

8

applicant's facility; providing an effective date.

Be It Enacted by the Legislature of the State of Florida:

11

     Section 1. This act may be cited as the "Equal Treatment

13

under the Law for All Pari-mutuels Act."

14

     Section 2.  Paragraph (a) of subsection (10) of section

15

551.104, Florida Statutes, is amended to read:

16

     551.104  License to conduct slot machine gaming.--

17

     (10)(a)  No slot machine license or renewal thereof shall be

18

issued to an applicant holding a permit under chapter 550 to

19

conduct pari-mutuel wagering meets of thoroughbred racing unless

20

the applicant has on file with the division a binding written

21

agreement between the applicant and the Florida Horsemen's

22

Benevolent and Protective Association, Inc., the Florida

23

Standardbred Breeders and Owners Association, the Florida

24

Greyhound Association, Inc., and the International Jai Alai

25

Players Association governing the payment of purses on live

26

thoroughbred races conducted at the licensee's pari-mutuel

27

facility. In addition, no slot machine license or renewal thereof

28

shall be issued to such an applicant unless the applicant has on

29

file with the division a binding written agreement between the

30

applicant and the Florida Thoroughbred Breeders' Association,

31

Inc., the Florida Standardbred Breeders and Owners Association,

32

the Florida Greyhound Association, Inc., and the International

33

Jai Alai Players Association governing the payment of breeders',

34

stallion, and special racing awards on live thoroughbred races

35

conducted at the licensee's pari-mutuel facility. The agreement

36

governing purses and the agreement governing awards may direct

37

the payment of such purses and awards from revenues generated by

38

any wagering or gaming the applicant is authorized to conduct

39

under Florida law. All purses and awards shall be subject to the

40

terms of chapter 550. All sums for breeders', stallion, and

41

special racing awards shall be remitted monthly to the Florida

42

Thoroughbred Breeders' Association, Inc., for the payment of

43

awards subject to the administrative fee authorized in s.

44

550.2625(3).

45

     Section 3.  This act shall take effect July 1, 2008.
