2An act relating to physician assistants; amending s.
3458.347, F.S.; revising the requirements for the formulary
4established by the Council on Physician Assistants in
5order to allow physician assistants to prescribe
6antipsychotics and parenteral preparations; providing an
7effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Paragraph (f) of subsection (4) of section
12458.347, Florida Statutes, is amended to read:
13     458.347  Physician assistants.--
14     (4)  PERFORMANCE OF PHYSICIAN ASSISTANTS.--
15     (f)1.  The council shall establish a formulary of medicinal
16drugs that a fully licensed physician assistant, licensed under
17this section or s. 459.022, may not prescribe. The formulary
18must include controlled substances as defined in chapter 893,
19antipsychotics, general anesthetics, and radiographic contrast
20materials, and all parenteral preparations except insulin and
21epinephrine.
22     2.  In establishing the formulary, the council shall
23consult with a pharmacist licensed under chapter 465, but not
24licensed under this chapter or chapter 459, who shall be
25selected by the State Surgeon General.
26     3.  Only the council shall add to, delete from, or modify
27the formulary. Any person who requests an addition, deletion, or
28modification of a medicinal drug listed on such formulary has
29the burden of proof to show cause why such addition, deletion,
30or modification should be made.
31     4.  The boards shall adopt the formulary required by this
32paragraph, and each addition, deletion, or modification to the
33formulary, by rule. Notwithstanding any provision of chapter 120
34to the contrary, the formulary rule shall be effective 60 days
35after the date it is filed with the Secretary of State. Upon
36adoption of the formulary, the department shall mail a copy of
37such formulary to each fully licensed physician assistant,
38licensed under this section or s. 459.022, and to each pharmacy
39licensed by the state. The boards shall establish, by rule, a
40fee not to exceed $200 to fund the provisions of this paragraph
41and paragraph (e).
42     Section 2.  This act shall take effect July 1, 2008.
