House Comm: RCS . 03/17/2009 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Environmental Preservation and Conservation (Jones) recommended the following: 1 Senate Amendment to Amendment (170490) (with title 2 amendment) 3 4 Between lines 109 and 110 5 insert: 6 (h) A community based social club shall be classified as 7 “first-come, first-served” for the purposes of assessing fees 8 pursuant to this section provided the club is designated as a 9 501(c)(7) by TITLE 26, subtitle A, CHAPTER 1, Subchapter F, PART 10 1, Sec. 501 of the United States Internal Revenue Code. The club 11 must be organized for pleasure, recreation and other similar 12 nonprofitable purposes and substantially all of its activities 13 must be for these purposes; and, the club shall not discriminate 14 based on race, color, religion or handicap. The club shall not 15 convey to any member the exclusive use of a club wet slip and 16 all wet slips must be available first come, first serve to all 17 members in a specific membership category. Any publications 18 related to membership and wet slip rental contracts shall state 19 that the wet slips are available on a first come, first serve 20 basis to all members in a specific membership category and that 21 the club does not discriminate based on race, color, religion or 22 handicap. Upon the date the club is found to have conveyed, 23 deeded, leased long term, included automatic renewal or 24 conditions or issues in any form an exclusive right to use a wet 25 slip, the submerged land lease fee shall revert to the private 26 rate pursuant to this section, and be subject to retroactive 27 private lease fees. The club shall provide recreational, 28 educational or charitable activities at least once annually 29 which are open to the general public beginning within 365 days 30 of the lease anniversary date. 31 32 Renumber subsequent subsections 33 34 ================= T I T L E A M E N D M E N T ================ 35 And the title is amended as follows: 36 Delete lines 229 - 231 37 and insert: 38 events; and detailing minimum compliance standards; providing 39 for the assessment of fees for community based social clubs; 40 amending s. 253.04, F.S.; requiring for the assessment of fines; 41 providing an effective date.
