    1                        A bill to be entitled                      
    2         An act relating to enterprise zones; creating s.
    3         290.00725, F.S.; authorizing Martin County to apply to
    4         the Office of Tourism, Trade, and Economic Development
    5         for designation of one enterprise zone within a
    6         specified area; exempting residential condominiums
    7         from benefiting from incentives derived from state
    8         enterprise zones; providing an application deadline;
    9         specifying the area encompassed by the enterprise
   10         zone; requiring that the office establish the initial
   11         effective date of the enterprise zone; providing an
   12         effective date.

   14  Be It Enacted by the Legislature of the State of Florida:
   15         
   16         Section 1. Section 290.00725, Florida Statutes, is created
   17  to read:
   18         290.00725Enterprise zone designation for Martin County.
   19  Martin County may apply to the Office of Tourism, Trade, and
   20  Economic Development for designation of one enterprise zone for
   21  an area within Martin County, encompassing an area not to exceed
   22  10 square miles. Such area shall consist of land within the
   23  primary urban services boundary and shall focus primarily on
   24  Indiantown, but shall exclude property owned by Florida Power
   25  and Light to the west, two areas to the north designated as
   26  estate residential, and the county-owned Timer Powers
   27  recreational area. Within the enterprise zone, residential
   28  condominiums shall be exempt from benefiting from incentives
   29  derived from state enterprise zones, unless prohibited by state
   30  law. The application must be submitted by December 31, 2009, and
   31  must comply with the requirements of s. 290.0055.
   32  Notwithstanding the provisions of s. 290.0065, limiting the
   33  total number of enterprise zones designated and the number of
   34  enterprise zones within a population category, the Office of
   35  Tourism, Trade, and Economic Development may designate one
   36  enterprise zone under this section. The Office of Tourism,
   37  Trade, and Economic Development shall establish the initial
   38  effective date of the enterprise zone designated pursuant to
   39  this section.
   40         Section 2. This act shall take effect upon becoming a law.
