A bill to be entitled
2An act relating to first-responder services; creating ss.
3125.01045 and 166.0446, F.S.; prohibiting counties and
4municipalities from imposing a fee or seeking
5reimbursement for costs relating to certain first-
6responder services; providing exceptions; defining the
7term "first responder"; providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:
10
11     Section 1.  Section 125.01045, Florida Statutes, is created
12to read:
13     125.01045  Prohibition of fees for first-responder
14services.--
15     (1)  A county may not impose a fee or seek reimbursement
16for any costs or expenses that may be incurred for services
17provided by a first responder, including costs or expenses
18related to personnel, supplies, motor vehicles, or equipment in
19response to a motor vehicle accident, except for costs of
20materials to contain or clean up hazardous waste in quantities
21reportable to the Florida State Warning Point at the Division of
22Emergency Management and costs for transportation and treatment
23provided by ambulance services licensed pursuant to s.
24401.23(5).
25     (2)  As used in this section, the term "first responder"
26means a law enforcement officer as defined in s. 943.10, a
27firefighter as defined in s. 633.30, or an emergency medical
28technician or paramedic as defined in s. 401.23 who is employed
29by the state or a local government. A volunteer law enforcement
30officer, firefighter, or emergency medical technician or
31paramedic engaged by the state or a local government is also
32considered a first responder of the state or local government
33for purposes of this section.
34     Section 2.  Section 166.0446, Florida Statutes, is created
35to read:
36     166.0446  Prohibition of fees for first-responder
37services.--
38     (1)  A municipality may not impose a fee or seek
39reimbursement for any costs or expenses that may be incurred for
40services provided by a first responder, including costs or
41expenses related to personnel, supplies, motor vehicles, or
42equipment in response to a motor vehicle accident, except for
43costs of materials to contain or clean up hazardous waste in
44quantities reportable to the Florida State Warning Point at the
45Division of Emergency Management and costs for transportation
46and treatment provided by ambulance services licensed pursuant
47to s. 401.23(5).
48     (2)  As used in this section, the term "first responder"
49means a law enforcement officer as defined in s. 943.10, a

51technician or paramedic as defined in s. 401.23 who is employed
52by the state or a local government. A volunteer law enforcement

57     Section 3.  This act shall take effect July 1, 2009.
