Florida Senate - 2009 SB 1050 By Senator Joyner 18-00389A-09 20091050__ 1 A bill to be entitled 2 An act relating to Medicaid; requiring the Agency for 3 Health Care Administration to report to the Governor 4 and the Legislature regarding Medicaid's refusal to 5 provide reimbursement for preventable medical errors; 6 requiring the agency to identify preventable medical 7 errors that are not reimbursed by Medicaid programs in 8 other states, the Medicare program, and private 9 insurers and recommend to the Governor and the 10 Legislature an expanded list of preventable medical 11 errors for which the Medicaid program may refuse 12 reimbursement; providing an effective date. 13 14 Be It Enacted by the Legislature of the State of Florida: 15 16 Section 1. (1) By February 1, 2010, the Agency for Health 17 Care Administration shall report to the Governor, the President 18 of the Senate, and the Speaker of the House of Representatives: 19 (a) The number and types of preventable medical errors that 20 occurred in hospitals from July 1, 2008, to December 31, 2009, 21 for which the state Medicaid program refused reimbursement and 22 the dollar value of the denied claims. 23 (b) Whether there was a decline in the number of billings 24 by hospitals for preventable medical errors under the state 25 Medicaid policy since July 1, 2008, and the estimated cost 26 saving to Medicaid. 27 (c) Any obstacles or impediments experienced by the agency 28 in implementing the policy of Medicaid's refusal to reimburse 29 hospitals for preventable medical errors that occurred from July 30 1, 2008, to December 31, 2009. 31 (2) The agency shall identify preventable medical errors 32 for which Medicaid programs in other states, the Medicare 33 program, and private insurers do not provide reimbursement, and 34 recommend to the Governor, the President of the Senate, and the 35 Speaker of the House of Representatives by February 1, 2010, an 36 expanded list of preventable medical errors for which this 37 state's Medicaid program may refuse reimbursement. 38 Section 2. This act shall take effect July 1, 2009.
