       The Committee on Judiciary (Joyner) recommended the following:
       
    1         Senate Amendment 
    2  
    3         Delete line 159
    4  and insert:
    5  hearing on the merits of the motion. Upon motion or request of a
    6  party, a court shall not refer any case to mediation if it finds
    7  there has been a history of domestic violence that would
    8  compromise the mediation process.
