A bill to be entitled
2An act relating to the Lake Worth Drainage District, Palm
3Beach County; codifying, reenacting, amending, and
4repealing chapters 98-525, 99-422, and 2003-344, Laws of
5Florida; providing an effective date.

7Be It Enacted by the Legislature of the State of Florida:
8
9     Section 1.  (1)  The reenactment of existing law in this
10act shall not be construed as a grant of additional authority to
11nor to supersede the authority of any entity pursuant to law.
12Exceptions to law contained in any special act that are
13reenacted pursuant to this act shall continue to apply.
14     (2)  The reenactment of existing law in this act shall not
15be construed to modify, amend, or alter any covenants,
16contracts, or other obligations of the district with respect to
17bonded indebtedness. Nothing pertaining to the reenactment of
18existing law in this act shall be construed to affect the
19ability of the district to levy and collect taxes, assessments,
20fees, or charges for the purpose of redeeming or servicing
21bonded indebtedness of the district.
22     Section 2.  Chapters 98-525, 99-422, and 2003-344, Laws of
23Florida, are codified, reenacted, amended, and repealed as
24herein provided.
25     Section 3.  The Lake Worth Drainage District is re-created,
26and the charter is re-created and reenacted to read:
27     Section 1.  District created and boundaries thereof.--For
28the purpose of further reclaiming, draining, and irrigating the
29lands hereinafter described, and for the purpose of water
30control and water supply; protecting said lands from the effects
31of water by means of the construction and maintenance of canals,
32ditches, levees, dikes, pumping plants, and other drainage and
33irrigation works and improvements; improving said lands and
34making said lands within the district available, acceptable, and
35habitable for settlement and agriculture, and for the public
36convenience, welfare, utility, and benefit and other purposes
37stated in this act, a single purpose drainage and water control
38district is hereby created and established in Palm Beach County,
39to be known as the Lake Worth Drainage District, an independent
40special district, the territorial boundaries of which shall
41include the following lands, to wit:
42Beginning at the North right-of-way line of the
43Hillsborough Canal on the East line of Section 35,
44Township 47 South, Range 42 East; thence running North
45along the East line of said Section 35 and along the
46East line of Section 26, Section 23, and Section 14,

2806     Section 2.  Provisions of chapter 298, Florida Statutes,
2807made applicable.--The Lake Worth Drainage District hereby
2808created shall be a public corporation of this state. The
2809provisions of the general drainage laws of Florida applicable to
2810drainage districts or subdrainage districts which are embodied
2811in chapter 298, Florida Statutes, so far as not inconsistent
2812with this act, are hereby declared to be applicable to said Lake
2813Worth Drainage District. The Lake Worth Drainage District shall

2815by said chapter 298, Florida Statutes, except as herein
2816otherwise provided, and shall have the authority to engage in
2817comprehensive water management activities.
2818     Section 3.  Powers of district.--The district shall have
2819the power to sue and be sued by its name in any court of law or
2820in equity; to make contracts; to adopt and use a corporate seal
2821and to alter the same at pleasure; to acquire by purchase, gift,
2822or condemnation real and personal property, either or both,
2823within or without the district, and to convey and dispose of
2824such real and personal property, either or both, as may be
2825necessary or convenient to carry out the purposes, or any of the
2826purposes, of this act and chapter 298, Florida Statutes; to
2827construct, operate, renovate, and maintain canals, ditches,
2828drains, levees, and other works for drainage and irrigation
2829purposes; to acquire, purchase, operate, and maintain pumps,
2830plants, and pumping systems for drainage and irrigation
2831purposes; to construct, operate, and maintain all types of
2832irrigation works, machinery, and plants; to construct, improve,
2833and maintain roadways and roads necessary and convenient for the
2834exercise of the powers and duties, or any of the powers or
2835duties, of the district or the supervisors thereof; to borrow
2836money and issue negotiable or other bonds of the district as
2837hereinafter provided; to borrow money from time to time and
2838issue negotiable or other notes of the district therefor,
2839bearing interest at a rate not exceeding the maximum rate
2840allowed by general law for public bodies, agencies, and
2841political subdivisions as provided in section 215.84, Florida
2842Statutes, in anticipation of collection of taxes, levies, and
2843assessments or revenues of the district, and to pledge or
2844hypothecate such taxes, levies, assessments, and revenues to
2845secure such bonds, notes, or obligations, and to sell, discount,
2846negotiate, and dispose of the same; and to exercise all other
2847powers necessary, convenient, or proper in connection with any
2848of the powers or duties of the district stated in this act. The
2849powers and duties of the district shall be exercised by and
2850through a board of supervisors, which shall have the authority
2851to employ engineers, attorneys, agents, employees, and
2852representatives as the board may from time to time determine,
2853and to fix their compensation and duties.
2854     Section 4.  Board of supervisors; elections.--
2855     (1)  BOARD OF SUPERVISORS.--There is hereby created a Board
2856of Supervisors of the Lake Worth Drainage District, which shall
2857be the governing body of the district. The board of supervisors
2858shall consist of five persons. All of the qualified voters of
2859the entire district shall be allowed to vote for the election of
2860all of the supervisors to be elected. All supervisors shall hold
2861office for terms of 3 years each and until their successors are
2862duly elected and qualified.
2863     (a)  Hereafter, on the first Wednesday after the 3rd of
2864January, qualified supervisors shall be elected for terms of 3
2865years each, by the landowners of the district, to take the place
2866of the retiring supervisor.
2867     (b)  Whenever an election is authorized or required by this
2868subsection to be held by the landowners at any particular or
2869stated time of day, and if, for any reason, such election is not
2870or cannot be held at such time or on such day, then in such
2871event and in all and every such event the power or duty to hold
2872such election shall not cease or lapse, but such election shall
2873be held thereafter as soon as practicable and consistent with
2874this subsection.
2875     (c)  In addition to the notice required by law, the
2876district shall cause notice to be published, once a week for 2
2877consecutive weeks immediately preceding the date of the regular
2878district election, in a newspaper of general circulation in the
2879district, of not less than one-fourth page size, providing a map
2880of the district and the date, time, and location of where the
2881election will be held. The district shall also take all steps to
2882ensure that there is a reasonable level of publicity concerning
2883the election.
2884     (2)  SINGLE-MEMBER SUBDISTRICT ELECTIONS; SUBDISTRICT
2885BOUNDARIES.--
2886     (a)  Definitions.--As used in this subsection, the term:
2887     1.  "Board" means the Board of Supervisors of the Lake
2888Worth Drainage District.
2889     2.  "District" means the Lake Worth Drainage District.
2890     3.  "Qualified elector" means any person at least 18 years
2891of age who is a citizen of the United States, a permanent
2892resident of Florida, and a freeholder, freeholder's spouse, or
2893authorized representative of a legal entity holding title to
2894land in the district. Presidents or other indicated officers or
2895agents may represent corporations or other legal entities,
2896guardians may represent their wards, and executors and
2897administrators may represent the estates of deceased persons and
2898be qualified to represent the corporate landowner and hold the
2899office of supervisor.
2900     (b)  Single-member subdistrict elections.--
2901     1.  Members of the board of supervisors shall be elected
2902from five single-member subdistricts, the boundaries of which
2903are set forth in paragraph (c). Each acre, or fraction thereof,
2904of land in the district shall represent one vote, and each owner
2905shall be entitled to one vote, in person or by proxy, for every
2906acre, or fraction thereof, of land owned within the district.
2907The subdistrict candidate receiving the greatest number of votes
2908shall be the supervisor from that subdistrict.
2909     2.  Qualifications.--Elections for board members shall be
2910nonpartisan. A candidate for the office of supervisor of
2911subdistrict 3, 4, or 5 shall at the time of election be a
2912landowner and resident of the subdistrict for which he or she
2913qualifies. Each candidate to be qualified for the office of
2914supervisor of subdistrict 1 or 2 shall at the time of election
2915be a qualified elector of the district.
2916     3.  Vacancies.--A vacancy shall occur if a supervisor
2917ceases to be qualified for the seat that he or she holds. If any
2918vacancy occurs in a seat occupied by a governing board member,
2919the remaining members of the board shall, within 45 days after
2920receipt of a resignation or other event causing a vacancy,
2921appoint a person who would be eligible to hold the office until
2922the next regularly scheduled district election at which time an
2923election will be held to fill the unexpired term of the vacant
2924seat.
2925     (c)  Boundaries of single-member subdistricts.-- The
2926district shall be divided for the purposes of electing members
2927to the board upon the following territorial boundaries:
2928     1.  The boundary lines of subdistrict 1 shall be: all that

2930DISTRICT lying westerly of the centerline of FLORIDA'S TURNPIKE
2931and lying northerly of the South lines of BLOCKS 59 and 60, PALM
2932BEACH FARMS CO. PLAT NO. 3, as same is recorded in Plat Book 2
2933at pages 45 through 54, Public Records of Palm Beach County,
2934Florida, and northerly of the South line of Township 45 South,
2935Range 41 East, all in Palm Beach County.
2936     2.  The boundary lines of subdistrict 2 shall be: all that
2937part of the JURISDICTIONAL LIMITS OF THE LAKE WORTH DRAINAGE
2938DISTRICT lying westerly of the centerline of FLORIDA'S TURNPIKE
2939and lying southerly of the North lines of BLOCKS 62 and 63, PALM
2940BEACH FARMS CO. PLAT NO. 3, as same is recorded in Plat Book 2
2941at pages 45 through 54, Public Records of Palm Beach County,
2942Florida, and southerly of the North line of Township 46 South,
2943Range 41 East, all in Palm Beach County.
2944     3.  The boundary lines of subdistrict 3 shall be: all that
2945part of the JURISDICTIONAL LIMITS OF THE LAKE WORTH DRAINAGE
2946DISTRICT lying easterly of the centerline of FLORIDA'S TURNPIKE
2947and lying northerly of the South line of Township 44 South,
2948Range 42 East, and northerly of the South line of Township 44
2949South, Range 43 East, all in Palm Beach County.
2950     4.  The boundary lines of subdistrict 4 shall be: all that
2951part of the JURISDICTIONAL LIMITS OF THE LAKE WORTH DRAINAGE
2952DISTRICT lying easterly of the centerline of FLORIDA'S TURNPIKE
2953and lying southerly of the North line of Township 44 1/2 South,
2954Range 42 East, and southerly of the North line of Township 44
29551/2 South, Range 43 East, and lying northerly of the centerline
2956of DELRAY WEST ROAD (State Road 806), all in Palm Beach County.
2957     5.  The boundary lines of subdistrict 5 shall be: all that
2958part of the JURISDICTIONAL LIMITS OF THE LAKE WORTH DRAINAGE
2959DISTRICT lying easterly of the centerline of FLORIDA'S TURNPIKE
2960and lying southerly of the centerline of DELRAY WEST ROAD (State
2961Road 806), all in Palm Beach County.
2962     Section 5.  Regular and special meetings of board of
2963supervisors.--The Board of Supervisors of the Lake Worth
2964Drainage District shall meet monthly at such date, time, and
2965place as the board may from time to time designate and until a
2966contrary designation is made by the board. The monthly meeting
2967shall be held at 8:30 a.m. on the first Wednesday after the 10th
2968day of each month at the general offices of the Lake Worth
2969Drainage District. A vote of a majority of the board may waive
2970the necessity of any regular monthly meeting. Special meetings
2971of the board shall be held at any time upon the call of the
2972president.
2973     Section 6.  Compensation of board of supervisors.--Each
2974supervisor shall be paid a salary for services rendered on
2975behalf of Lake Worth Drainage District. The payment of said
2976salary shall qualify each supervisor for membership in the
2977Florida Retirement System in accordance with the provisions of
2978chapter 121, Florida Statutes. Said salary shall be paid at the
2979rate of $150 for each day services are rendered. Supervisors
2980shall be paid for district travel and expenses in accordance
2981with the provisions of chapter 112, Florida Statutes.
2982     Section 7.  Meetings of landowners; election of
2983supervisors.--
2984     (1)  Each year at 9 a.m. on the first Wednesday after the
29853rd of January, a meeting of the landowners of the district
2986shall be held for the purpose of electing supervisors to take
2987the place of retiring supervisors and hearing reports of the
2988board of supervisors and considering any matters upon which the
2989board may request the advice and views of the landowners. The
2990president of the board shall have the power to call special
2991meetings of the landowners at any time to receive reports of the
2992board or consider any act upon any matter which the board may
2993request advice. Notice of all meetings of the landowners shall
2994be given by the board by causing publication thereof to be made
2995once a week for 2 consecutive weeks prior to such meeting in
2996some newspaper published in Palm Beach County. The meeting of
2997the landowners shall be held at the principal office of the Lake
2998Worth Drainage District or in some other public place in said
2999county and the place, day, and hour of holding said meeting
3000shall be stated in the notice.
3001     (2)  The landowners, when assembled, shall organize by
3002electing a chair who shall preside at the meeting. The secretary
3003of the board shall be secretary of such meeting. At each such
3004meeting, each acre, or fraction thereof, of land in the district
3005shall represent one share and each owner shall be entitled to
3006one vote, in person or by proxy, for every acre, or fraction
3007thereof, of land owned by him or her in the district.
3008     (3)  A majority of acres in the district shall constitute a
3009quorum of any meeting of the landowners. If no quorum is present
3010or represented at such meeting at the time and place the meeting
3011is called to be held, and if the meeting has been regularly
3012called as required in this act, then a majority of the acres of
3013landowners present and represented, though constituting less
3014than a quorum, shall have the power to elect supervisors and
3015shall transact all of the business that could have been
3016transacted had a quorum been present.
3017     (4)  Presidents or other indicated executive officers may
3018represent corporations, guardians may represent their wards, and
3019personal representatives may represent the estates of deceased
3020persons. Trustees may represent lands held by them in trust and
3021private and municipal corporations may be represented by their
3022officers or duly authorized agents. Guardians, personal
3023representatives, trustees, and corporations may also vote by
3024proxy.
3025     (5)  Any qualified person desiring to become a candidate
3026for election to the board of supervisors of the district shall
3027file written notice of his or her intention to seek said office
3028with the general manager of the district at the general office
3029on or prior to the adjournment of the regularly scheduled board
3030of supervisors meeting during the month preceding said
3031landowners' meeting. Failing to so file will disqualify any
3032person for consideration at such election.
3033     (6)  As to the elections of supervisors, the qualified
3034candidate receiving the highest number of votes for supervisor
3035shall be declared and elected as such supervisor. If more than
3036one person is nominated for any vacancy on the board of
3037supervisors, the candidate receiving the majority of the votes
3038shall be elected. In the event no candidate receives a majority,
3039then the landowners shall vote on two candidates receiving the
3040most votes in a runoff election and the one receiving the
3041majority shall be elected.
3042     Section 8.  Installment taxes, levied and apportioned and
3043the collection thereof.--Taxes shall be levied and apportioned
3044as provided for in the general drainage and water laws of
3045Florida (chapter 298, Florida Statutes), except that the
3046provisions of sections 298.365 and 298.41, Florida Statutes,
3047shall not be applicable to the district. In lieu thereof, the
3048following provisions shall apply to the district:
3049     (1)  The board of supervisors shall determine, order, and
3050levy the amount of the annual installment of the total taxes
3051levied under section 298.36, Florida Statutes, which shall
3052become due and be collected during each year at the same time
3053that county taxes are due and collected, which said annual
3054installment and levy shall be evidenced to and certified by the
3055board not later than August 31 of each year to the Property
3056Appraiser of Palm Beach County.
3057     (2)  Said tax shall be extended by the county property
3058appraiser on the county tax roll and shall be collected by the
3059county tax collector in the same manner and time as the county
3060taxes and the proceeds thereof paid to the district.
3061     Section 9.  Maintenance tax.--The provisions of section
3062298.54, Florida Statutes, shall not be applicable to the
3063district. In lieu thereof, the following provision shall apply
3064to the district: to maintain and preserve the existing
3065improvements and assets for the district, as well as the
3066improvements made pursuant to this chapter, and to repair and
3067restore the same when needed, for the purpose of defraying the
3068current expenses of the district, the board of supervisors shall
3069levy a uniform annual acreage tax, the same being a unit of tax
3070upon each acre or fraction thereof on all property in the
3071district as determined for county taxing purposes, to be known
3072as "maintenance tax." Said maintenance tax shall be evidenced to
3073and certified by the board not later than August 31 of each year
3074to the Property Appraiser of Palm Beach County, and shall be
3075extended by the county property appraiser on the county tax roll
3076and shall be collected by the county tax collector in the same
3077manner and time as county taxes and the proceeds therefrom paid
3078on the property against which assessed, and enforceable in like
3079manner as county taxes. Each acre or fraction of an acre, for
3080the purposes of this section, shall be taxed as an acre unit.
3081     Section 10.  Irrigation tax.--
3082     (1)  The Lake Worth Drainage District is hereby permitted,
3083authorized, and empowered to engage in irrigation as well as
3084drainage. The term "irrigation" means the maintaining and
3085controlling of water levels within the district by means of
3086pumping operations or through gravity flow from reservoirs and
3087installing, operating, keeping, and maintaining pumps, pumping
3088stations, dams, floodgates, and such other waterworks and
3089controls that the board of supervisors may deem necessary and
3090proper.
3091     (2)  In order to defray the costs of irrigation, the
3092district is authorized, permitted, and empowered to levy and
3093assess taxes as herein provided. Said taxes shall be determined,
3094levied, and assessed not later than the regular monthly meeting
3095of the board in July of each year. The board shall, at such
3096time, determine lands that have been benefited by irrigation.
3097     (3)  At the regular monthly meeting in July of each year,
3098the general manager of the district shall submit a budget
3099showing the estimated costs for the year of maintaining water
3100tables. The board shall examine the budget and revise it if
3101necessary. After the budget has been fully approved by the
3102board, the board shall then assess against the lands benefited
3103an irrigation tax sufficient to defray the cost of irrigation.
3104     (4)  Within 2 weeks after the assessment has been made,
3105notice of the assessment shall be given by publication in some
3106newspaper published in Palm Beach County. One such publication
3107shall be sufficient. It shall not be necessary for this notice
3108to describe the lands assessed other than to refer to them as
3109lands within the irrigation area of the Lake Worth Drainage
3110District, and the notice may state merely the amount of
3111assessment per acre.
3112     (5)  Should there be any objections to the assessment made
3113against the lands as provided herein, such objection shall be
3114made to the board of supervisors each year after the publication
3115of the assessment roll at its next regular monthly meeting. The
3116board shall consider the objections and sustain, adjust, or
3117overrule the same. After consideration of objections, if any
3118have been made and determined as above, the board shall cause
3119the assessment to be certified to the Property Appraiser of Palm
3120Beach County, together with a list of lands subject to the
3121assessment, at the same time and in the same form and manner as
3122other drainage taxes of the district are certified. The county
3123property appraiser shall combine the assessment for irrigation
3124with the drainage district tax assessment and extend them on the
3125county tax rolls and the taxes shall be collected by the county
3126tax collector in the same manner and time as county taxes and
3127the proceeds therefrom paid to the Lake Worth Drainage District.
3128The taxes shall be a lien until paid on the property against
3129which assessed and enforceable in like manner as county taxes.
3130When remittance of taxes is made by the county to the district,
3131the board, from information furnished to it by the general
3132manager and records of the district, shall determine what part
3133of the remittance is for irrigation and shall set aside the
3134irrigation portion so found and determined into an irrigation
3135fund for the district, to be used for the purpose for which it
3136was assessed.
3137     Section 11.  Special improvements; assessments against
3138specially improved property.--
3139     (1)  The Board of Supervisors of the Lake Worth Drainage
3140District is hereby authorized and empowered in the manner
3141hereinafter provided to cause any and all canals, bulkheads,
3142dikes, levees, drains, culverts, and other types of waterways,
3143water controls, or improvements thereunto related, as well as
3144streets or roads incident thereto, to be dug, constructed,
3145paved, or built, and to provide for all or any part of the
3146installation costs thereof, and to provide for the annual
3147maintenance involved by levying and collecting special
3148installation assessments and maintenance assessments upon
3149abutting, adjoining, and contiguous or other specially benefited
3150properties. The amount assessed against the property benefited
3151for any installation of such improvements shall not exceed the
3152estimated benefits accruing to such property by reason of the
3153special improvements. The maintenance costs of the special
3154improvements shall be annually assessed against the affected
3155property in direct proportion to the resulting benefit.
3156     (2)  Special assessments upon the property benefited by any
3157improvement herein authorized shall be effected by one or both
3158of the following methods:
3159     (a)  In proportion to the benefit which may result from
3160such improvements.
3161     (b)  By front footage of property bounding or abutting upon
3162such improvement.
3163     (3)  Upon the board of supervisors' own initiative, or when
3164the owners of a majority of the acres of land liable to be
3165assessed for any special or local improvements, or when the
3166owners of a majority of the foot frontage of land liable to be
3167assessed for any special or local improvements petition the
3168board for its consideration of any local special improvement,
3169the board may order such improvement to be made and, in such an
3170event, the following are the general conditions and regulations
3171governing said special assessments and improvements:
3172     (a)  Before any special or local improvement is authorized
3173or made under the provisions of this section, the board of
3174supervisors shall, by resolution, require plans, specifications,
3175and estimates of cost of such improvements to be made and placed
3176on file in the general offices of the district.
3177     (b)  When the board of supervisors determines to make such
3178special or local improvements, then it shall so declare by
3179resolution, stating the necessity for, and the nature of, the
3180proposed special improvements and stating further what part of
3181the expenses therefor shall be paid by special assessment
3182against the affected property. The resolution shall also state
3183the total estimated cost of the proposed improvement, the method
3184of payment of assessment, the number of annual installments, and
3185the rate of interest on deferred payments, which interest shall
3186not exceed 8 percent.
3187     (c)  The resolution may embrace improvements of like
3188character upon or in more than one canal or other type of
3189waterway or control, street, or road and such improvements need
3190not be contiguous. The resolution shall designate the boundaries
3191of the area comprising the property that the board deems will be
3192specially benefited by such improvement. The estimated costs
3193stated in the resolution shall include an estimate of the cost
3194of preliminary or other surveys, inspections, and supervision of
3195the work, the preparation of the plans and specifications, the
3196printing and publishing of notices and proceedings, the
3197preparation of certificates and bonds, and any other expenses
3198necessary or proper, which expenses, except the cost of the work
3199itself, are hereinafter referred to as incidental expenses. The
3200improvements covered by a single resolution may be designated in
3201all proceedings, assessments, or publications by any short or
3202convenient designation and the property against which
3203assessments may be made for the cost of such improvements may be
3204designated as an area, followed by a letter or number or name to
3205distinguish it from other such areas.
3206     (d)  The resolution to be adopted as aforesaid shall be
3207published in a newspaper published in Palm Beach County once
3208each week for 2 consecutive weeks and shall be certified to by
3209the secretary of the board of supervisors. There shall also be
3210published a notice setting forth that the board has determined
3211the necessity for the improvements to be made according to plans
3212and specifications on file in the general offices of the Lake
3213Worth Drainage District, that the same are required to be made,
3214and that the board will sit at a place and upon a date and hour
3215not earlier than 3 days from the final publication of such
3216notice for the purpose of hearing objections to the proposed
3217improvements.
3218     (e)  If, at the time fixed in the notice, the persons
3219owning property abutting upon or within the area to be benefited
3220by the improvements have not already constructed the same in
3221accordance with the plans and specifications aforesaid and, if
3222no objections have been made or, if having been made, the
3223objections have been deemed insufficient by the board of
3224supervisors, the board shall have the improvements made, either
3225by contract or directly, by the employment of labor and purchase
3226of materials; or separate contracts may be entered into for the
3227performance of different classes of work included in any single
3228improvement.
3229     (f)  After the completion of the improvement or in the
3230event the improvement is made by contract, after the awarding of
3231all contracts included in such improvement in such manner that
3232the total actual cost of said improvement can be determined, the
3233treasurer of the board of supervisors shall prepare and present
3234to the board a report of costs of the improvements and an
3235assessment roll showing the lands assessed to pay the costs
3236thereof and the amount of the assessment as to each. The report
3237of costs must show the total cost of the improvement and the
3238estimated costs of incidental expenses and that portion of the
3239total cost chargeable to the respective parcels of land,
3240including real estate owned by the Lake Worth Drainage District
3241and including real estate within the Lake Worth Drainage
3242District abutting upon the improvement for which the assessment
3243is made. Such costs chargeable to said properties shall be upon
3244front footage of such specially improved property, which amount
3245shall be the portion of the total cost chargeable to all
3246abutting property, divided by the number of feet fronting or
3247abutting upon the improvement, and/or such costs chargeable to
3248said properties shall be in the amount that the board deems to
3249be proportionate to the special benefits received by lots or
3250parcels of land within the boundaries of the area designated in
3251the resolution authorizing such improvements as hereinbefore
3252provided and not in excess of such benefits.
3253     (g)  The board of supervisors shall thereupon approve the
3254report of costs and assessment roll if the same is in proper
3255form, and the same shall be placed on file in the general
3256offices of the Lake Worth Drainage District; and the assessment
3257roll shall be advertised once each week for 2 consecutive weeks
3258in a newspaper published in Palm Beach County, together with a
3259notice to be signed by the Secretary of the Lake Worth Drainage
3260District setting forth that the assessment roll has been
3261examined and approved by the board and the board shall sit upon
3262a certain date and hour, not earlier than 3 days from the final
3263publication of such notice, for the purpose of hearing
3264objections to said assessment roll. If no objections are made by
3265persons affected by the assessment roll at the time and place
3266specified in the aforesaid notice or if objections have been
3267made and have been determined insufficient by the board, the
3268board shall thereupon adopt a resolution levying the assessments
3269as shown by the assessment roll and reciting by what method or
3270combination of methods the special assessment is made and the
3271time when the same shall become payable and the special
3272assessments to be levied shall be a lien upon the date of the
3273assessment upon the respective lots or parcels of land described
3274in the resolution. The special assessments shall be evidenced to
3275and certified by the board not later than August 31 of each year
3276to the Property Appraiser of Palm Beach County, and shall be
3277extended by the county property appraiser on the county tax roll
3278and the annual installments thereon shall be collected from year
3279to year by the county tax collector in the same manner and time
3280as county taxes and the proceeds therefrom are paid to the
3281district. The assessment shall be a lien until paid on the
3282property against which assessed and enforceable in like manner
3283as county taxes.
3284     (h)  The commencement of work on any special improvement as
3285provided for in this section shall constitute notice to the
3286owners of the property abutting upon, adjoining, or contiguous
3287to, and to be benefited by, such improvement; and special
3288assessments will be levied against such property and liens
3289created and held against the same for the benefits received by
3290reason of such improvements.
3291     Section 12.  Taxes and costs a lien on land against which
3292taxes assessed.--All taxes provided for in this act, together
3293with all penalties for default in payment of same, and all costs
3294in collecting the same shall, from the date of assessment
3295thereof until paid, constitute a lien of equal dignity with the
3296liens for county taxes upon all the lands against which said
3297taxes are levied as provided for in this chapter.
3298     Section 13.  When unpaid taxes delinquent; penalty and
3299discounts.--All taxes provided for in this act shall be and
3300become delinquent and bear penalties on the amount of said taxes
3301in the same manner as county taxes and shall be subject to the
3302same discounts as county taxes.
3303     Section 14.  Compensation of property appraiser, tax
3304collector, and clerk of the circuit court.--The Property
3305Appraiser, Tax Collector, and Clerk of the Circuit Court of Palm
3306Beach County shall be entitled to compensation for services
3307performed in connection with taxes of the district at the same
3308rate as applied to county taxes.
3309     Section 15.  Bonds may be issued, sale and disposition of
3310proceeds; interest; levy to pay bonds, bonds and duties of
3311treasurer, etc.--
3312     (1)  The board of supervisors may, if in its judgment it
3313seems best, issue bonds not to exceed 90 percent of the total
3314amount of the taxes levied under the provisions of section
3315298.36, Florida Statutes, and/or levied under the provisions of
3316section 11, and such bonds shall be in denominations of not less
3317than $100, bear interest from date at a rate not to exceed 6
3318percent per annum, payable annually or semiannually, to mature
3319at annual intervals within 40 years commencing after a period of
3320not less than 10 years, to be determined by the board, both
3321principal and interest payable at some convenient place
3322designated by the board to be named in said bonds, which bonds
3323shall be signed by the president of the board, attested with the
3324seal of the district and by the signature of the secretary of
3325the board. All of the bonds shall be executed and delivered to
3326the treasurer of the district, who shall sell the same in such
3327quantities and at such dates as the board may deem necessary to
3328meet the payments for the works and improvements in the
3329district. The bonds shall not be sold for less than 90 cents on
3330the dollar, with accrued interest, shall show on their face the
3331purpose for which they are issued, and shall be payable out of
3332money derived from the aforesaid taxes. A sufficient amount of
3333the drainage tax shall be appropriated by the board for the
3334purpose of paying the principal and interest of said bonds, and
3335the same, when collected, shall be preserved in a separate fund
3336for that purpose and no other. All bonds and coupons not paid at
3337maturity shall bear interest at the rate of 6 percent per annum
3338from maturity until paid, or until sufficient funds have been
3339deposited at the place of payment, and said interest shall be
3340appropriated by the board out of the penalties and interest
3341collected on delinquent taxes or other available funds of the
3342district. However, it may, in the discretion of the board, be
3343provided that at any time, after such date as shall be fixed by
3344the board, said bonds may be redeemed before maturity at the
3345option of the board, or its successors in office, by being made
3346callable prior to maturity at such time and upon such prices and
3347terms and other conditions as the board shall determine. If any
3348bond so issued subject to redemption before maturity is not
3349presented when called for redemption, it shall cease to bear
3350interest from and after the date so fixed for redemption.
3351     (2)  The board of supervisors of the district shall have
3352authority to issue refunding bonds to take up any outstanding
3353bonds and any interest accrued thereon when, in the judgment of
3354the board, it shall be for the best interest of the district so
3355to do. The board is hereby authorized and empowered to issue
3356refunding bonds to take up and refund all bonds of the district
3357outstanding that are subject to call and prior redemption, and
3358all interest accrued to the date of such call or prior
3359redemption, and all bonds of the district that are not subject
3360to call or redemption, together with all accrued interest
3361thereon, where the surrender of said bonds can be procured from
3362the holders thereof at prices satisfactory to the board or can
3363be exchanged for such outstanding bonds with the consent of the
3364holder thereof. Such refunding bonds may be issued at any time
3365when, in the judgment of the board, it will be to the interest
3366of the district financially or economically to secure a lower
3367rate of interest on the bonds or by extending the time of
3368maturity of the bonds, or for any other reason in the judgment
3369of the board advantageous to the district. Such refunding bonds
3370may mature at any time or times in the discretion of the board,
3371not later, however, than 40 years from the date of issuance of
3372said refunding bonds. The refunding bonds shall bear such date
3373of issue and such other details as the board shall determine and
3374may in the discretion of the board be made callable prior to
3375maturity at such times and upon such prices and terms and other
3376conditions as the board shall determine. All the other
3377applicable provisions of this act not inconsistent therewith
3378shall apply fully to the refunding bonds and the holders thereof
3379shall have all the rights, remedies, and securities of the
3380outstanding bonds refunded, except as may be provided otherwise
3381in the resolution of the board authorizing the issuance of such
3382refunding bonds. Any funds available in the sinking fund for the
3383payment of the principal and interest of outstanding bonds may
3384be retained in the fund to be used for the payment of principal
3385and interest of the refunding bonds, in the discretion of the
3386board of supervisors. Any expenses incurred in buying any or all
3387bonds authorized under the provisions of this section and the
3388interest thereon and a reasonable compensation for paying same
3389shall be paid out of the funds in the hands of the treasurer and
3390collected for the purpose of meeting the expenses of
3391administration. It shall be the duty of the board of supervisors
3392in making the annual tax levy as heretofore provided to take
3393into account the maturing bonds and interest on all bonds and
3394expenses, and to make provision in advance for the payment of
3395same.
3396     (3)  In case the proceeds of the original tax levy made
3397under the provisions of section 298.36, Florida Statutes, are
3398not sufficient to pay the principal and interest of all bonds
3399issued, then the board of supervisors shall make such additional
3400levy or levies upon the benefits assessed as are necessary for
3401this purpose, and under no circumstances shall any tax levies be
3402made that will in any manner or to any extent impair the
3403security of said bonds or the fund available for the payment of
3404the principal and interest of the same. The treasurer shall, at
3405the time of his or her receipt of said bonds, execute and
3406deliver to the president of the board of the district a bond
3407with good and sufficient surety to be approved by the board,
3408conditioned that he or she shall account for and pay over as
3409required by law and as ordered by the board of supervisors, any
3410and all moneys received by him or her on the sale of such bonds,
3411or any of them, and that he or she will only sell and deliver
3412such bonds to the purchaser or purchasers thereof under and
3413according to the terms herein prescribed, and that he or she
3414will return to the board of supervisors and duly cancel any and
3415all bonds not sold when ordered by the board to do so. The bonds
3416when so returned shall remain in the custody of the president of
3417the board of supervisors, who shall produce the same for
3418inspection or for use as evidence whenever and wherever legally
3419requested so to do. The treasurer shall promptly report all
3420sales of bonds to the board of supervisors. The board shall at
3421reasonable times thereafter prepare and issue warrants in
3422substantially the form provided in section 298.17, Florida
3423Statutes, for the payment of maturing bonds so sold and the
3424interest payments coming due on all bonds sold. Each of the
3425warrants shall specify which bonds and accruing interest it is
3426to pay, and the treasurer shall place sufficient funds at the
3427place of payment to pay the maturing bonds and coupons when due,
3428together with necessary compensation for paying same. The
3429successor in office of such treasurer shall not be entitled to
3430the bonds or the proceeds thereof until he or she has complied
3431with all of the foregoing provisions applicable to this
3432predecessor in office. The aforesaid bond of the treasurer may,
3433if the board so directs, be furnished by a surety or bonding
3434company, which may be approved by said board of supervisors;
3435however, if it is deemed more expedient to the board of
3436supervisors as to money derived from the sale of bonds issued,
3437the board may, by resolution, select some suitable bank or banks
3438or other depository as temporary treasurer or treasurers to hold
3439and disburse the moneys upon the order of the board as the work
3440progresses, until such fund is exhausted or transferred to the
3441treasurer by order of the board of supervisors. The funds
3442derived from the sale of the bonds or any of them shall be used
3443for the purpose of paying the cost of the drainage works and
3444improvements, and such costs, fees, expenses, and salaries as
3445may be authorized by law, and used for no other purpose.
3446     Section 16.  Full authority for issue and sale of bonds
3447authorized.--
3448     (1)  This act shall, without reference to any other act of
3449the Legislature, be full authority for the issuance and sale of
3450the bonds authorized in this act, which bonds shall have all the
3451qualities of negotiable paper under the law merchant and shall
3452not be invalid for any irregularity or defect in the proceedings
3453for the issuance and sale thereof, and shall be incontestable in
3454the hands of bona fide purchasers or holders thereof. No
3455proceedings in respect to the issuance of any such bonds shall
3456be necessary, except such as are required by this act. The
3457provisions of this act shall constitute an irrepealable contract
3458between the board of supervisors and the Lake Worth Drainage
3459District and the holders of any bonds and the coupons thereof
3460issued pursuant to the provisions hereof. Any holder of any of
3461said bonds or coupons may either in law or in equity by suit,
3462action, or mandamus enforce and compel the performance of the
3463duties required by this act of any of the officers or persons
3464mentioned in this act in relation to the bonds, or to the
3465correct enforcement and application of the taxes for the payment
3466thereof.
3467     (2)  After the several bonds and coupons are paid and
3468retired as herein provided, they shall be returned to the
3469treasurer, and they shall be canceled and an appropriate record
3470thereof made in a book to be kept for that purpose, which record
3471of paid and canceled bonds shall be kept at the office of the
3472treasurer and shall be open for inspection of any bondholder at
3473any time.
3474     Section 17.  Floating indebtedness.--Prior to the issuance
3475of bonds under the provisions of this act, the board of
3476supervisors may from time to time issue warrants or negotiable
3477notes or other evidences of debt of the district, all of which
3478shall be termed "floating indebtedness" in order to distinguish
3479the same from the bonded debt provided for. The notes or other
3480evidences of indebtedness shall be payable at such times and
3481shall bear interest at the rate not exceeding the maximum rate
3482allowed by general law for public bodies, agencies, and
3483political subdivisions as provided for in section 215.84,
3484Florida Statutes, and may be sold or discounted at such time or
3485on such terms as the board may deem advisable. The board shall
3486have the right, in order to provide for the payment thereof, to
3487pledge the whole or any part of the taxes provided for in this
3488act, whether the same shall be theretofore or thereafter levied,
3489and the board shall have the right to provide that the floating
3490debt shall be payable from the proceeds arising from the sale of
3491bonds, or from the proceeds of any such tax, or both. After the
3492issuance of any bonds of the district under the provisions of
3493this act, the power to create such floating debt and pledge the
3494avails of taxes therefor shall continue.
3495     Section 18.  Use of bonds and interest coupons in payment
3496of taxes not authorized.--The provisions of section 298.73,
3497Florida Statutes, relating to the use of bonds and obligations
3498in payment of drainage taxes, shall not be applicable to the
3499district and its bonds, obligations, and taxes.
3500     Section 19.  Eminent domain.--The board of supervisors is
3501hereby authorized and empowered to exercise the right of eminent
3502domain and may condemn for the use of the district any and all
3503lands, easements, rights-of-way, riparian rights, and property
3504rights of every description, in or out of the district, required
3505for the public purposes and powers of the board as herein
3506granted, and may enter upon, take, and use such lands as it may
3507deem necessary for such purposes.
3508     Section 20.  Legislative determination, district
3509improvements and facilities needed, water a common enemy.--It is
3510hereby declared and determined that the growth and expansion of
3511urban residential areas within the boundaries of the Lake Worth
3512Drainage District has created urgent demand and necessity for
3513the expansion of the facilities of irrigation, water control,
3514water outfall, widening and improving the drainage facilities,
3515and reclaiming the wetlands; and it is further declared that in
3516the district, the surface waters, which shall include rainfall
3517and the overflow of rivers and streams, are a common enemy and
3518that the district and any individual or agency holding a permit
3519to do so from the district shall have the right to dike, dam,
3520and construct levees to protect the district or any part thereof
3521or the property of any individual or agency against the same and
3522thereby divert the course and flow of such surface waters and/or
3523pump the water from within such dikes and levees.
3524     Section 21.  Annexation of new territory; procedure;
3525objection thereto.--The Lake Worth Drainage District of Palm
3526Beach County may change its territorial limits by the annexation
3527of any lands lying contiguous thereto or abutting upon any one
3528of its canal rights-of-way lying within said county by either
3529one of the following methods:
3530     (1)  By filing with the Lake Worth Drainage District a
3531petition of the fee the titleholder of the subject property
3532sought to be annexed, indicating said titleholder's desire to be
3533annexed and indicating the authority for same. Thereupon, the
3534district, upon determination that it can serve the lands and is
3535willing to have said lands included within its boundaries and
3536subjected to its jurisdiction, shall determine same by
3537resolution extending the district's boundaries so as to include
3538the land areas described in the petition; and, upon filing the
3539resolution with the Clerk of the Circuit Court in and for Palm
3540Beach County, said lands shall be deemed included within the
3541Lake Worth Drainage District and liable for assessment and
3542payment of any and all taxes and liabilities as if the lands had
3543been included within the district as of the date of this act.
3544     (2)  If such tract contains less than 10 freeholders, the
3545supervisors shall, by resolution duly passed, declare its
3546intention to annex such tract of land to the Lake Worth Drainage
3547District at the expiration of 15 days from the adoption of the
3548resolution, which resolution shall thereupon be published in
3549full once a week for 2 consecutive weeks in some newspaper
3550published in Palm Beach County. If, at any time prior to the
3551expiration of 15 days, any 15 freeholders in the Lake Worth
3552Drainage District or any four or more freeholders of real estate
3553in the district so proposed to be annexed shall object to such
3554annexation, they may apply by petition to the Circuit Court of
3555Palm Beach County, setting forth in the petition the proposed
3556proceedings of the Board of Supervisors of the Lake Worth
3557Drainage District and the grounds of their objections thereto.
3558Thereupon, the circuit court shall order notice of the
3559application to be served upon the Lake Worth Drainage District
3560and appoint a day for the hearing of the application, and all
3561further action in the proceedings by the Lake Worth Drainage
3562District shall thereupon be stayed until the further order of
3563court. If, upon the hearing of such an application, the court
3564sustains the objection, the tract of land shall not be annexed;
3565otherwise, the application and objection shall be discharged and
3566the tract of land shall be annexed to the Lake Worth Drainage
3567District. Such petition may be heard and determined by the court
3568at any time, and questions of fact may be determined by such
3569court without a jury, but each party may demand a jury if it so
3570desires. If no objection is filed and notice served as aforesaid
3571within the 15-day period, the Board of Supervisors of the Lake
3572Worth Drainage District may proceed by further resolution to
3573annex said tract of land and to redefine the boundaries of the
3574Lake Worth Drainage District so as to include therein the tract
3575of land, and said tract of land shall be annexed upon the filing
3576of such resolution with the Clerk of the Circuit Court in and
3577for Palm Beach County, and said lands shall be deemed included
3578within the Lake Worth Drainage District and liable for
3579assessment and payment of any and all taxes and liabilities as
3580if the lands had been included within the district at the time
3581of the original creation of same.
3582     (3)  If the tract of land so proposed to be annexed
3583contains 10 or more freeholders, the resolution proposing to
3584annex said land shall be submitted to a separate vote of the
3585freeholders who are registered voters of the Lake Worth Drainage
3586District and of the freeholders with the district so proposed to
3587be annexed in Palm Beach County. Such election shall be called
3588and conducted and the expense thereto paid by the Lake Worth
3589Drainage District and the tract of land shall not be annexed
3590unless such annexation is approved by a majority of the
3591freeholders within the district proposed to be annexed actually
3592voting at such an election and by a majority of the registered
3593voters within the Lake Worth Drainage District actually voting
3594at such an election.
3595     Section 22.  Unit development; powers of supervisors to
3596designate units of district and adopt system of progressive
3597drainage by units; water control plans and financing
3598assessments, etc., for each unit.--The Board of Supervisors of
3599the Lake Worth Drainage District shall have the power and is
3600hereby authorized in its discretion to drain and reclaim or more
3601completely and intensively to drain and reclaim the lands in the
3602district by designated areas or parts of the district to be
3603called "units." The units into which the district may be so
3604divided shall be given appropriate numbers or names by the board
3605of supervisors, so that said units may be readily identified and
3606distinguished. The board of supervisors shall have the power to
3607fix and determine the location, area, and boundaries of and
3608lands to be included in each and all such units, the order of
3609development thereof, and the method of carrying on the work in
3610each unit. The unit system of drainage provided by this section
3611may be conducted and all of the proceedings by this section and
3612this act authorized in respect to such unit or units may be
3613carried on and conducted at the same time as or after the work
3614of draining and reclaiming of the entire district has been or is
3615being or shall be instituted or carried on under the provisions
3616of this act. If the board of supervisors shall determine that it
3617is advisable to conduct the work of draining and reclaiming the
3618lands in the district by units, as authorized by this section,
3619the board shall, by resolution duly adopted and entered upon its
3620minutes, declare its purpose to conduct such work accordingly,
3621and shall at the same time and manner fix the number, location
3622and boundaries of, and description of lands within such unit or
3623units and give them appropriate numbers or names. As soon as
3624practicable after the adoption and recording of such resolution,
3625the board of supervisors shall publish notice once a week for 2
3626consecutive weeks in a newspaper published in Palm Beach County
3627briefly describing the units into which the district has been
3628divided and the lands embraced in each unit, giving the name,
3629number, or other designation of such units, requiring all owners
3630of lands in the district to show cause in writing before the
3631board of supervisors at a time and place to be stated in such
3632notice why such division of the district into such units should
3633not be approved and the system of development by units should
3634not be adopted and given effect by the board, and why the
3635proceedings and powers authorized by this section should not be
3636had, taken, and exercised. At the time and place stated in the
3637notice, the board of supervisors shall hear all objections or
3638causes of objection, all of which shall be in writing, of any
3639landowner in the district to the matters mentioned and referred
3640to in such notice and, if no objections are made or if said
3641objections, if made, are overruled by the board, then the board
3642shall enter in its minutes its finding and order confirming said
3643resolution, and may thereafter proceed with the development,
3644drainage, and reclamation of the district by units pursuant to
3645such resolution and to the provisions of this act. If, however,
3646the board of supervisors shall find as a result of such
3647objections, or any of them, or the hearing thereon, that the
3648division of the district into such units as aforesaid should not
3649be approved, or that the system of development by units should
3650not be adopted and given effect, or that the proceedings and
3651powers authorized by this section should not be had, taken, or
3652exercised, or that any other matter or thing embraced in the
3653resolution would not be in the best interest of the landowners
3654of the district or would be unjust or unfair to any landowner
3655therein or otherwise inconsistent with fair and equal protection
3656and enforcement of the rights of every landowner in the
3657district, then the board of supervisors shall not proceed
3658further under such resolution; but the board of supervisors may,
3659as a result of such hearing, modify or amend said resolution so
3660as to meet such objections, and thereupon the board may confirm
3661the resolution as so modified or amended and may thereafter
3662proceed accordingly. The sustaining of such objections and the
3663rescinding of such resolutions shall not exhaust the power of
3664the board under this section; but, at any time not less than 1
3665year after the date of the hearing upon any such resolution, the
3666board of supervisors may adopt other resolutions under this
3667section and thereupon proceed on due notice in like manner as
3668above. If the board of supervisors overrules or refuses to
3669sustain any such objections in whole or in part made by any
3670landowner in the district, or if any landowner shall deem
3671himself or herself aggrieved by any action of the board of
3672supervisors in respect to any objections so filed, such
3673landowner may, within 10 days after the ruling of the board,
3674file his or her bill of complaint in the Circuit Court for Palm
3675Beach County against the district, praying an injunction or
3676other appropriate relief against the action or any part of such
3677action proposed by such resolution or resolutions of the board,
3678and such suits shall be conducted like other suits in equity,
3679except that said suits shall have preference over all other
3680pending actions except criminal actions and writs of habeas
3681corpus. Upon the hearing of the cause, the circuit court shall
3682have the power to hear the objections and receive the evidence
3683thereon of all parties to such cause and approve or disapprove
3684said resolutions and action of the board in whole or in part,
3685and to render such decree in such cause as right and justice
3686require. When the resolutions creating the unit system are
3687confirmed by the board of supervisors, or by the Circuit Court
3688of Palm Beach County, if such proposed action is challenged by a
3689landowner by the judicial proceedings hereinabove authorized,
3690the board of supervisors may adopt a water control plan or plans
3691for and in respect to any or all such units, and have the
3692benefits and damages resulting therefrom assessed and
3693apportioned, and the engineer's report considered and confirmed,
3694all in like manner as is provided by law in regard to water
3695control plans and assessments for benefits and damages of the
3696entire district. With respect to the water control plan,
3697notices, assessment of benefits and damages, engineer's report
3698and notice and confirmation thereof, the levy of assessments and
3699taxes, including maintenance taxes, and the issuance of bonds,
3700and all other proceedings as to each and all of such units, the
3701board shall follow and comply with the same procedure as is
3702provided by law with respect to the entire district; and the
3703board of supervisors shall have the same powers in respect to
3704each and all of such units as is vested in them with respect to
3705the entire district. All the provisions of this act shall apply
3706to the drainage, reclamation, and improvement of each, any, and
3707all of such units; and the enumeration of or reference to
3708specific powers or duties of the supervisors or any other
3709officers or other matters in this act as hereinabove set forth
3710shall not limit or restrict the application of any and all of
3711the proceedings and powers herein to the drainage and
3712reclamation of such units as fully and completely as if such
3713unit or units were specifically and expressly named in every
3714section and clause of this act where the entire district is
3715mentioned or referred to. All assessments, levies, taxes, bonds,
3716and other obligations made, levied, assessed, or issued for or
3717in respect to any such unit or units shall be a lien and charge
3718solely and only upon the lands in such unit or units,
3719respectively, for the benefit of which the same is levied, made,
3720or issued, and not upon the remaining units or lands in the
3721district. The board of supervisors may at any time amend its
3722resolutions by changing the location and description of lands in
3723any such unit or units. Further, if the location of or
3724description of lands located in any such unit or units is so
3725changed, notice of such change shall be published as hereinabove
3726required in this section for notice of the formation or
3727organization of such unit or units, and all proceedings shall be
3728had and done in that regard as are provided in this section for
3729the original creation of such unit or units; however, no lands
3730against which benefits are assessed may be detached from any
3731such unit after the confirmation of the engineer's report of
3732benefits in such unit or units or the issuance of bonds or other
3733obligations which are payable from taxes or assessments for
3734benefits levied upon the lands within such unit or units.
3735However, if, after the confirmation of the engineer's report of
3736benefits in such unit or units, or the issuance of bonds or
3737other obligations which are payable from taxes or assessments
3738for benefits levied upon lands within such unit or units, the
3739board of supervisors finds the water control plan for any such
3740unit or units insufficient or inadequate for efficient
3741development, the water control plan may be amended or changed as
3742provided in chapter 298, Florida Statutes, and the unit or units
3743may be amended or changed as provided in this section, by
3744changing the location and description of lands in any such unit
3745or units, by detaching lands therefrom or by adding land
3746thereto, upon the approval of at least 51 percent of the
3747landowners according to acreage, in any such unit and of all of
3748the holders of bonds issued in respect to any such unit, and
3749provided that in such event all assessments, levies, taxes,
3750bonds, and other obligations made, levied, assessed, incurred,
3751or issued for or in respect to any such unit or units may be
3752allocated and apportioned to the amended unit or units in
3753proportion to the benefits assessed by the engineer's report for
3754the amended water control plan and said report specifically
3755provide for such allocation and apportionment. The landowners
3756and all of the bondholders shall file their approval of or
3757objections to such amended water control plan within the time
3758provided in s. 298.301, Florida Statutes, and shall file their
3759approval of or objections to the amendment of such unit as
3760provided in this section. No lands shall be detached from any
3761unit after the issuance of bonds or other obligations for such
3762unit except upon the consent of all the holders of such bonds or
3763other obligations. In the event of the change of the boundaries
3764of any unit as provided herein and the allocation and
3765apportionment to the amended unit or units of assessments,
3766levies, taxes, bonds, and other obligations in proportion to the
3767benefits assessed by the engineer's report for the amended water
3768control plan, the holder of bonds or other obligations
3769heretofore issued for the original unit who consent to such
3770allocations and apportionment shall be entitled to all rights
3771and remedies against any lands added to the amended unit or
3772units as fully and to the same extent as if such added lands had
3773formed and constituted a part of the original unit or units at
3774the time of the original issuance of such bonds or other
3775obligations, and regardless of whether the holders of such bonds
3776or other obligations are the original holders thereof or the
3777holders from time to time hereafter, and the rights and remedies
3778of such holders against the lands in the amended unit or units,
3779including any lands added thereto, under such allocation and
3780apportionment, shall constitute vested and irrevocable rights
3781and remedies to the holders from time to time of such bonds or
3782other obligations as fully and to the same extent as if such
3783bonds or other obligations had been originally issued to finance
3784the improvements in such amended unit or units under such
3785amended plan of reclamation.
3786     Section 23.  District liability.--The provisions of any
3787general law or special act to the contrary notwithstanding, the
3788following provisions control with respect to the liability of
3789the Lake Worth Drainage District relating to persons using the
3790district's lands, rights-of-way, works, or easements for
3791authorized, permitted, or licensed activities for facilities or
3792for outdoor recreational purposes:
3793     (1)  Except as provided in subsection (3), when the Lake
3794Worth Drainage District individually or jointly, with another
3795agency of government, authorizes, permits, or licenses
3796activities for facilities within district rights-of-way or
3797works, or lands over which the Lake Worth Drainage District has
3798a legally established easement right, thereby allowing access to
3799or use of such lands, rights-of-way, works, or easements for
3800such purposes or for outdoor recreational purposes, the Lake
3801Worth Drainage District shall not be liable for personal injury
3802or damages caused by the negligent or willful and intentional
3803acts of a permittee or their invitees that may occur as a result
3804of carrying out the permitted activity or from the use of such
3805authorized, permitted, or licensed facilities.
3806     (2)  Other than as specified in subsection (3), when the
3807Lake Worth Drainage District's lands, rights-of-way, works, or
3808easements are used or accessed by the public for authorized,
3809permitted, or licensed activities for facilities or for outdoor
3810recreational purposes, the Lake Worth Drainage District does not
3811by the authorization for such use or access extend any assurance
3812that such lands, rights-of-way, works, or easements are safe for
3813any purpose, does not by such authorization incur any duty of
3814care toward a person who goes onto those lands, rights-of-way,
3815or easements, and is not responsible for any injury to persons
3816or property caused by a negligent act or omission of any person
3817who goes onto those lands, rights-of-way, works, or easements.
3818     (3)  This section does not relieve the Lake Worth Drainage
3819District of any liability that would otherwise exist for
3820negligence or any deliberate, willful, or malicious injury to a
3821person or property as provided by applicable Florida law. This
3822section does not create or increase the liability of Lake Worth
3823Drainage District or any person beyond that which is authorized
3824by section 768.28, Florida Statutes.
3825     (4)  The term "outdoor recreational purposes" as used in
3826this section includes activities such as, but not limited to,
3827horseback riding, hunting, fishing, bicycling, swimming,
3828boating, camping, picnicking, hiking, pleasure driving, nature
3829study, water skiing, motorcycling, and visiting historical,
3830archeological, scenic, or scientific sites.
3831     Section 24.  It is intended that the provisions of this act
3832shall be liberally construed for accomplishing the work
3833authorized and provided for or intended to be provided for by
3834this act, and where strict construction would result in the
3835defeat of the accomplishment of any part of the work authorized
3836by this act, and a liberal construction would permit or assist
3837in the accomplishment of any part of the work authorized by this
3838act, the liberal construction shall be chosen.
3839     Section 25.  Nothing in this act shall change existing law
3840as to whether or the extent to which the provisions of chapters
3841253, 369, 373, and 403, Florida Statutes, shall apply.
3842     Section 4.  Chapters 98-525, 99-422, and 2003-344, Laws of
3843Florida, are repealed.
3844     Section 5.  This act shall take effect July 1, 2009.
