    1                        A bill to be entitled                      
    2         An act relating to voyeurism; amending s. 810.14,
    3         F.S.; prohibiting secretly viewing, for specified
    4         purposes, under or through the clothing being worn by
    5         another person without that person’s knowledge or
    6         consent in order to view the body of, or the
    7         undergarments worn by, that person; providing
    8         penalties; providing an effective date.

   10  Be It Enacted by the Legislature of the State of Florida:
   11  
   12         Section 1. Section 810.14, Florida Statutes, is amended to
   13  read:
   14         810.14 Voyeurism prohibited; penalties.—
   15         (1) A person commits the offense of voyeurism if that
   16  person:
   17         (a)when he or she, With lewd, lascivious, or indecent
   18  intent, secretly observes another person when the other person
   19  is located in a dwelling, structure, or conveyance and such
   20  location provides a reasonable expectation of privacy; or
   21         (b)For amusement, entertainment, or sexual arousal or
   22  gratification, secretly views under or through the clothing
   23  being worn by another person without that person’s knowledge or
   24  consent in order to view the body of, or the undergarments worn
   25  by, that person.
   26         (2) A person who violates this section commits a
   27  misdemeanor of the first degree for the first violation,
   28  punishable as provided in s. 775.082 or s. 775.083.
   29         (3) A person who violates this section and who has been
   30  previously convicted or adjudicated delinquent two or more times
   31  of any violation of this section commits a felony of the third
   32  degree, punishable as provided in s. 775.082, s. 775.083, or s.
   33  775.084.
   34         (4) For purposes of this section, a person has been
   35  previously convicted or adjudicated delinquent of a violation of
   36  this section if the violation resulted in a conviction sentenced
   37  separately, or an adjudication of delinquency entered
   38  separately, prior to the current offense.
   39         Section 2. This act shall take effect October 1, 2009.
