Florida Senate - 2009 SB 1096 By Senator Crist 12-00980A-09 20091096__ 1 A bill to be entitled 2 An act relating to color photographic or digital 3 imaged licenses; amending s. 322.142, F.S.; 4 authorizing the Department of Highway Safety and Motor 5 Vehicles to release to a law enforcement agency 6 multiple reproductions of images or updated images 7 from the print files or digital records for inclusion 8 in a facial-recognition biometrics database; providing 9 that the images continue to be exempt from public 10 disclosure while contained in the database; providing 11 an effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Subsection (4) of section 322.142, Florida 16 Statutes, is amended to read: 17 322.142 Color photographic or digital imaged licenses.— 18 (4) The department may maintain a film negative or print 19 file. The department shall maintain a record of the digital 20 image and signature of the licensees, together with other data 21 required by the department for identification and retrieval. 22 Reproductions from the file or digital record are exempt from 23 the provisions of s. 119.07(1) and shall be made and issued only 24 for departmental administrative purposes; for the issuance of 25 duplicate licenses; in response to law enforcement agency 26 requests; in a timely response to a request from a law 27 enforcement agency for multiple reproductions of images, or 28 updated images in the database, for the purpose of including the 29 images in the law enforcement agency's facial-recognition 30 biometrics database, within which such images shall remain 31 exempt from public disclosure; to the Department of State 32 pursuant to an interagency agreement to facilitate 33 determinations of eligibility of voter registration applicants 34 and registered voters in accordance with ss. 98.045 and 98.075; 35 to the Department of Revenue pursuant to an interagency 36 agreement for use in establishing paternity and establishing, 37 modifying, or enforcing support obligations in Title IV-D cases; 38 to the Department of Children and Family Services pursuant to an 39 interagency agreement to conduct protective investigations under 40 part III of chapter 39; or to the Department of Financial 41 Services pursuant to an interagency agreement to facilitate the 42 location of owners of unclaimed property, the validation of 43 unclaimed property claims, and the identification of fraudulent 44 or false claims. 45 Section 2. This act shall take effect July 1, 2009.
