    1                        A bill to be entitled                      
    2         An act relating to a review of the Department of
    3         Highway Safety and Motor Vehicles under the Florida
    4         Government Accountability Act; reenacting and amending
    5         s. 20.24, F.S., relating to the establishment of the
    6         department; eliminating an obsolete reference to the
    7         Bureau of Motor Vehicle Inspection; providing an
    8         effective date.
    9         
   10         WHEREAS, ss. 11.901-11.920, Florida Statutes, the Florida
   11  Government Accountability Act, subjects the Department of
   12  Highway Safety and Motor Vehicles and its respective advisory
   13  committees to a sunset review process in order to determine
   14  whether the agency should be retained, modified, or abolished,
   15  and
   16         WHEREAS, the Department of Highway Safety and Motor
   17  Vehicles produced a report providing specific information, as
   18  enumerated in s. 11.906, Florida Statutes, and
   19         WHEREAS, upon receipt of the report, the Joint Legislative
   20  Sunset Committee and committees of the Senate and the House of
   21  Representatives assigned to act as sunset review committees
   22  reviewed the report and requested studies by the Office of
   23  Program Policy Analysis and Government Accountability, and
   24         WHEREAS, based on the department's report, studies of the
   25  Office of Program Policy Analysis and Government Accountability,
   26  and public input, the Joint Legislative Sunset Committee and
   27  legislative sunset review committees made recommendations on the
   28  abolition, continuation, or reorganization of the Department of
   29  Highway Safety and Motor Vehicles and its advisory committees;
   30  on the need for the functions performed by the agency and its
   31  advisory committees; and on the consolidation, transfer, or
   32  reorganization of programs within the Department of Highway
   33  Safety and Motor Vehicles, and
   34         WHEREAS, this Legislature wishes to retain the Department
   35  of Highway Safety and Motor Vehicles and continue the Florida
   36  Highway Patrol Advisory Council, the Automobile Dealer Advisory
   37  Board, the DUI Programs Review Board, and the Medical Advisory
   38  Board, NOW, THEREFORE,

   40  Be It Enacted by the Legislature of the State of Florida:
   41         
   42         Section 1. Section 20.24, Florida Statutes, is reenacted
   43  and amended to read:
   44         20.24 Department of Highway Safety and Motor Vehicles.
   45  There is created a Department of Highway Safety and Motor
   46  Vehicles.
   47         (1) The head of the Department of Highway Safety and Motor
   48  Vehicles is the Governor and Cabinet.
   49         (2) The following divisions, and bureaus within the
   50  divisions, of the Department of Highway Safety and Motor
   51  Vehicles are established:
   52         (a) Division of the Florida Highway Patrol.
   53         (b) Division of Driver Licenses.
   54         (c) Division of Motor Vehicles.
   55         1. Bureau of Motor Vehicle Inspection.
   56         Section 2. This act shall take effect upon becoming a law.
