    1                        A bill to be entitled                      
    2         An act relating to the Department of Highway Safety
    3         and Motor Vehicles; reenacting and amending s. 20.24,
    4         F.S., relating to the establishment of the department;
    5         eliminating an obsolete reference to the Bureau of
    6         Motor Vehicle Inspection; providing for implementation
    7         of a litigation settlement; providing eligibility and
    8         procedures to collect the credit provided pursuant to
    9         such settlement; providing for expiration of the
   10         provision; providing an effective date.
   11         
   12         WHEREAS, ss. 11.901-11.920, Florida Statutes, the Florida
   13  Government Accountability Act, subjects the Department of
   14  Highway Safety and Motor Vehicles and its respective advisory
   15  committees to a sunset review process in order to determine
   16  whether the agency should be retained, modified, or abolished,
   17  and
   18         WHEREAS, the Department of Highway Safety and Motor
   19  Vehicles produced a report providing specific information, as
   20  enumerated in s. 11.906, Florida Statutes, and
   21         WHEREAS, upon receipt of the report, the Joint Legislative
   22  Sunset Committee and committees of the Senate and the House of
   23  Representatives assigned to act as sunset review committees
   24  reviewed the report and requested studies by the Office of
   25  Program Policy Analysis and Government Accountability, and
   26         WHEREAS, based on the department's report, studies of the
   27  Office of Program Policy Analysis and Government Accountability,
   28  and public input, the Joint Legislative Sunset Committee and
   29  legislative sunset review committees made recommendations on the
   30  abolition, continuation, or reorganization of the Department of
   31  Highway Safety and Motor Vehicles and its advisory committees;
   32  on the need for the functions performed by the agency and its
   33  advisory committees; and on the consolidation, transfer, or
   34  reorganization of programs within the Department of Highway
   35  Safety and Motor Vehicles, and
   36         WHEREAS, this Legislature wishes to retain the Department
   37  of Highway Safety and Motor Vehicles and continue the Florida
   38  Highway Patrol Advisory Council, the Automobile Dealer Advisory
   39  Board, the DUI Programs Review Board, and the Medical Advisory
   40  Board, NOW, THEREFORE,
   41         
   42  Be It Enacted by the Legislature of the State of Florida:
   43         
   44         Section 1. Section 20.24, Florida Statutes, is reenacted
   45  and amended to read:
   46         20.24 Department of Highway Safety and Motor Vehicles.
   47  There is created a Department of Highway Safety and Motor
   48  Vehicles.
   49         (1) The head of the Department of Highway Safety and Motor
   50  Vehicles is the Governor and Cabinet.
   51         (2) The following divisions, and bureaus within the
   52  divisions, of the Department of Highway Safety and Motor
   53  Vehicles are established:
   54         (a) Division of the Florida Highway Patrol.
   55         (b) Division of Driver Licenses.
   56         (c) Division of Motor Vehicles.
   57         1.Bureau of Motor Vehicle Inspection.
   58         Section 2. Implementation of litigation settlement
   59  provisions of Collier v. Dickinson.—
   60         (1)Any person who held a driver's license, identification
   61  card, or motor vehicle registration that was valid between June
   62  1, 2000, and September 30, 2004, is eligible to receive a single
   63  $1 credit on a new or renewed motor vehicle registration between
   64  July 1, 2009, and June 30, 2010.
   65         (2)The revenue generated by s. 320.08046, Florida
   66  Statutes, and deposited into the General Revenue Fund shall fund
   67  the $1 credit.
   68         (3)This section expires July 1, 2011.
   69         Section 3. This act shall take effect upon becoming a law.
