A bill to be entitled
2An act relating to the East County Water Control District,
3Lee and Hendry Counties; amending chapter 2000-423, Laws
4of Florida, as amended; amending district boundaries;
5providing for a board of commissioners in lieu of a board
6of supervisors; revising meeting attendance requirements;
7providing penalties for unexcused absences from meetings;
8providing for a salary; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Subsection (2) of section 1, section 3,

585     Section 3.  Maintenance assessments.--Maintenance
586assessments as provided for under section 298.54, Florida
587Statutes, shall be apportioned upon the basis of the net
588assessments of benefits assessed as accruing from original
589construction and any subsequent improvements, and shall be due
590and collected pursuant to section 298.54, Florida Statutes,
591chapter 197, Florida Statutes, and this act. Provided, nothing
592herein shall prevent the Board of Commissioners Supervisors from
593apportioning maintenance taxes for the maintenance of the
594district facilities equally to all benefited acres if the Board
595of Commissioners Supervisors determines that benefits are
596substantially equal for benefited acreage throughout the
597District. Said assessments shall be a lien until paid on the
598property against which assessed and enforceable in like manner
599as county taxes.
600     Section 4.  Board of Commissioners Supervisors; elections;
601candidate qualifications; powers and duties.--The provisions of
602chapter 298, Florida Statutes, to the contrary notwithstanding,
603the following provisions, to the extent of any conflict, shall
604control the East County Water Control District:
605     (1)  The Board of Commissioners Supervisors of the East
606County Water Control District shall be composed of five members
607who shall be registered voters and residents of the District.
608The Board of Commissioners Supervisors shall be elected at large
609by the electors residing in the District. Terms of all
610commissioners supervisors shall be for 4 years.
611     (2)  All District Commissioners Supervisors elections shall
612be held on the first Tuesday after the first Monday in November
613of even-numbered years. All District Commissioners Supervisors
614shall be elected at large by nonpartisan plurality vote with the
615candidate who receives the highest number of votes for each seat
616winning the election. Only registered voters residing within the
617District shall be permitted to vote. The cost of any election
618shall be borne by the District. Terms of all commissioners
619supervisors shall begin with the first regularly scheduled board
620meeting after certification of on the day after the election by
621the supervisor of elections as established by this act. The
622terms of the Board of Commissioners Supervisors of the East
623County Water Control District serving on May 27, 1998, shall be
624extended for one year to the first Tuesday after the first
625Monday in November of the even-numbered year following the year
626in which their term is currently due to expire.
627     (3)  Qualifying for the position of District Commissioners
628Supervisors shall be coordinated by the supervisors of elections
629of the counties within which the District is located. Methods of
630qualifying shall be uniform pursuant to section 99.092, Florida
631Statutes. Candidates shall be required to open depositories and
632appoint treasurers prior to accepting any contributions or
633expending any funds.
634     (4)  Vacancies on the Board shall be filled pursuant to
635chapter 100 section 298.12, Florida Statutes.
636     (5)  The members of the Board shall be reimbursed for their
637expenses pursuant to section 112.061, Florida Statutes, and paid
638a salary flat fee of $250 per calendar calender month during
639term of office as established herein. The Board may remove any
640member who has three consecutive, unexcused absences from
641regularly scheduled meetings. In addition, commissioners shall
642not be paid for any unexcused absences from regularly scheduled
643meetings. The Board shall adopt policies by resolution defining
644excused and unexcused absences, provided however, the flat fee
645of $250 per calendar month shall only be payable in the event
646the member of the Board attends at least one (1) full regularly
647scheduled session of the Board during the subject calendar
648month.
649     (6)  Each year, the Board of Commissioners Supervisors
650shall hold an annual organizational meeting, at which a Chair,
651Vice-Chair, Secretary and Treasurer shall be elected, whose
652duties shall be established by Resolution of the Board.
653     (7)  The Board of Commissioners Supervisors shall have the
654power to employ a person to be designated General Manager of the
655District and to vest in him or her such authority and to
656delegate to him or her the performance of such duties and to
657provide such compensation as may be determined by the Board of
658Commissioners Supervisors. The Board may require the General
659Manager to furnish bond with good and sufficient surety in such
660amount as the Board may by resolution determine.
661     Section 5.  Bonds issuable for 40 years.--Notwithstanding
662the provisions of section 298.47, Florida Statutes, the Board of
663Commissioners Supervisors may issue bonds maturing at annual
664intervals within 40 years.
665     Section 6.  Assessment records.--Notwithstanding the
666provisions of section 298.36(2), Florida Statutes, the secretary
667of the Board of Commissioners Supervisors , as soon as said
668total assessment is levied, shall, at the expense of the
669District, prepare a list of all assessments levied, said list to
670be stored in electronic format.
671     Section 2.  This act shall take effect upon becoming a law.
