1	A bill to be entitled
2	An act relating to the East County Water Control District,
3	Lee and Hendry Counties; amending chapter 2000-423, Laws
4	of Florida, as amended; amending district boundaries;
5	providing for a board of commissioners in lieu of a board
6	of supervisors; revising meeting attendance requirements;
7	providing penalties for unexcused absences from meetings;
8	providing for a salary; providing an effective date.

10	Be It Enacted by the Legislature of the State of Florida:
11
12	Section 1.  Subsection (2) of section 1, section 3,
13	subsections (1) through (7) of section 4, section 5, and section
14	6 of section 3 of chapter 2000-423, Laws of Florida, as amended
15	by chapters 2003-315 and 2006-319, Laws of Florida, are amended
16	to read:

585	Section 3.  Maintenance assessments.--Maintenance
586	assessments as provided for under section 298.54, Florida
587	Statutes, shall be apportioned upon the basis of the net
588	assessments of benefits assessed as accruing from original
589	construction and any subsequent improvements, and shall be due
590	and collected pursuant to section 298.54, Florida Statutes,
591	chapter 197, Florida Statutes, and this act. Provided, nothing
592	herein shall prevent the Board of Commissioners Supervisors from
593	apportioning maintenance taxes for the maintenance of the
594	district facilities equally to all benefited acres if the Board
595	of Commissioners Supervisors determines that benefits are
596	substantially equal for benefited acreage throughout the
597	District. Said assessments shall be a lien until paid on the
598	property against which assessed and enforceable in like manner
599	as county taxes.
600	Section 4.  Board of Commissioners Supervisors; elections;
601	candidate qualifications; powers and duties.--The provisions of
602	chapter 298, Florida Statutes, to the contrary notwithstanding,
603	the following provisions, to the extent of any conflict, shall
604	control the East County Water Control District:
605	(1)  The Board of Commissioners Supervisors of the East
606	County Water Control District shall be composed of five members
607	who shall be registered voters and residents of the District.
608	The Board of Commissioners Supervisors shall be elected at large
609	by the electors residing in the District. Terms of all
610	commissioners supervisors shall be for 4 years.
611	(2)  All District Commissioners Supervisors elections shall
612	be held on the first Tuesday after the first Monday in November
613	of even-numbered years. All District Commissioners Supervisors
614	shall be elected at large by nonpartisan plurality vote with the
615	candidate who receives the highest number of votes for each seat
616	winning the election. Only registered voters residing within the
617	District shall be permitted to vote. The cost of any election
618	shall be borne by the District. Terms of all commissioners
619	supervisors shall begin with the first regularly scheduled board
620	meeting after certification of on the day after the election by
621	the supervisor of elections as established by this act. The
622	terms of the Board of Commissioners Supervisors of the East
623	County Water Control District serving on May 27, 1998, shall be
624	extended for one year to the first Tuesday after the first
625	Monday in November of the even-numbered year following the year
626	in which their term is currently due to expire.
627	(3)  Qualifying for the position of District Commissioners
628	Supervisors shall be coordinated by the supervisors of elections
629	of the counties within which the District is located. Methods of
630	qualifying shall be uniform pursuant to section 99.092, Florida
631	Statutes. Candidates shall be required to open depositories and
632	appoint treasurers prior to accepting any contributions or
633	expending any funds.
634	(4)  Vacancies on the Board shall be filled pursuant to
635	chapter 100 section 298.12, Florida Statutes.
636	(5)  The members of the Board shall be reimbursed for their
637	expenses pursuant to section 112.061, Florida Statutes, and paid
638	a salary flat fee of $250 per calendar calender month during
639	term of office as established herein. The Board may remove any
640	member who has three consecutive, unexcused absences from
641	regularly scheduled meetings. In addition, commissioners shall
642	not be paid for any unexcused absences from regularly scheduled
643	meetings. The Board shall adopt policies by resolution defining
644	excused and unexcused absences, provided however, the flat fee
645	of $250 per calendar month shall only be payable in the event
646	the member of the Board attends at least one (1) full regularly
647	scheduled session of the Board during the subject calendar
648	month.
649	(6)  Each year, the Board of Commissioners Supervisors
650	shall hold an annual organizational meeting, at which a Chair,
651	Vice-Chair, Secretary and Treasurer shall be elected, whose
652	duties shall be established by Resolution of the Board.
653	(7)  The Board of Commissioners Supervisors shall have the
654	power to employ a person to be designated General Manager of the
655	District and to vest in him or her such authority and to
656	delegate to him or her the performance of such duties and to
657	provide such compensation as may be determined by the Board of
658	Commissioners Supervisors. The Board may require the General
659	Manager to furnish bond with good and sufficient surety in such
660	amount as the Board may by resolution determine.
661	Section 5.  Bonds issuable for 40 years.--Notwithstanding
662	the provisions of section 298.47, Florida Statutes, the Board of
663	Commissioners Supervisors may issue bonds maturing at annual
664	intervals within 40 years.
665	Section 6.  Assessment records.--Notwithstanding the
666	provisions of section 298.36(2), Florida Statutes, the secretary
667	of the Board of Commissioners Supervisors , as soon as said
668	total assessment is levied, shall, at the expense of the
669	District, prepare a list of all assessments levied, said list to
670	be stored in electronic format.
671	Section 2.  This act shall take effect upon becoming a law.
