| 2 | An act relating to auxiliary law enforcement officers; |
| 3 | creating s. 943.1305, F.S.; exempting certain applicants |
| 4 | for employment as part-time auxiliary law enforcement |
| 5 | officers from a requirement that they complete a basic |
| 6 | training program; providing an effective date. |

| 8 | Be It Enacted by the Legislature of the State of Florida: |
| 9 |
|
| 10 | Section 1. Section 943.1305, Florida Statutes, is created |
| 11 | to read: |
| 12 | 943.1305 Minimum qualifications for certain part-time |
| 13 | auxiliary law enforcement officers.-- |
| 14 | (1) Notwithstanding s. 943.13(9), an applicant for |
| 15 | employment as an auxiliary law enforcement officer may be |
| 16 | granted an exemption from completing a commission-approved basic |
| 17 | auxiliary training program if the applicant is not employed in a |
| 18 | full-time paid capacity and if the applicant: |
| 19 | (a) Submits verification from the employing agency or |
| 20 | criminal justice selection center that the applicant has |
| 21 | successfully completed a comparable basic auxiliary law |
| 22 | enforcement training program in another state; |
| 23 | (b) Demonstrates proficiency in high-liability areas, as |
| 24 | defined by commission rule; |
| 25 | (c) Has served as an auxiliary law enforcement officer in |
| 26 | another state for at least 1 year, with a maximum 8-year break |
| 27 | in service from the separation date of the applicant's most |
| 28 | recent qualifying service until the date the complete |
| 29 | application is submitted; and |
| 30 | (d) Complies with the requirements of s. 943.13(1)-(8). |
| 31 | (2) A person who qualifies as an auxiliary officer |
| 32 | pursuant to this section must comply with the requirements of |
| 33 | section 943.13(9) and complete a commission-approved basic |
| 34 | recruit training program before being employed in any capacity |
| 35 | as a paid law enforcement officer or correctional officer in |
| 36 | this state. |
| 37 | Section 2. This act shall take effect July 1, 2009. |
