       Senator Storms moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Delete lines 83 - 114
    4  and insert:
    5         (2)AGENCY AGREEMENTS.—
    6         (a)(3) The department shall enter into an agreement with
    7  the Department of Education regarding the education and related
    8  care of children known to the department. Such agreement shall
    9  be designed to provide educational access to children known to
   10  the department for the purpose of facilitating the delivery of
   11  services or programs to children known to the department. The
   12  agreement shall avoid duplication of services or programs and
   13  shall provide for combining resources to maximize the
   14  availability or delivery of services or programs. The agreement
   15  must require the Department of Education to access the
   16  department’s Florida Safe Families Network to obtain information
   17  about children known to the department, consistent with the
   18  Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. s.
   19  1232g.
   20         (b)(4) The department shall enter into agreements with
   21  district school boards or other local educational entities
   22  regarding education and related services for children known to
   23  the department who are of school age and children known to the
   24  department who are younger than school age but who would
   25  otherwise qualify for services from the district school board.
   26  Such agreements shall include, but are not limited to:
   27         1.(a) A requirement that the department shall:
   28         a.1. Enroll children known to the department in school. The
   29  agreement shall provide for continuing the enrollment of a child
   30  known to the department at the same school, if possible, with
   31  the goal of avoiding disruption of education.
   32         b.2. Notify the school and school district in which a child
   33  known to the department is enrolled of the name and phone number
   34  of the child known to the department caregiver and caseworker
   35  for child safety purposes.
   36         c.3. Establish a protocol for the department to share
   37  information about a child known to the department with the
   38  school district, consistent with the Family Educational Rights
   39  and Privacy Act, since the sharing of information will assist
   40  each agency in obtaining education and related services for the
   41  benefit of the child. The protocol must require the district
   42  school boards or other local educational entities to access the
   43  department’s Florida Safe Families Network to obtain information
   44  about children known to the department, consistent with the
   45  Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. s.

   49         And the title is amended as follows:
   50         Delete line 5
   51  and insert:
   52  “surrogate parent”; requiring the Department of Education and
   53  district school boards to access the Florida Safe Families
   54  Network to obtain information about children known to the
   55  Department of Children and Family Services; providing
   56  legislative intent;
