House Comm: WD . 04/01/2009 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Judiciary (Fasano) recommended the following: 1 Senate Amendment (with title amendment) 2 3 Between lines 298 and 299 4 insert: 5 (5) HOME EDUCATION PROGRAM ENROLLMENT.—Upon the request of 6 a foster parent, the department shall permit a child who is 7 living in a foster home to be enrolled in or change his or her 8 school setting to a home education program, pursuant to s. 9 1002.41, or a public or private school scholarship program, 10 pursuant to s.1002.39 or s. 220.187, if such a enrollment or 11 change in school setting is incorporated into the child’s case 12 plan and approved by the court. If the child has a surrogate 13 parent appointed pursuant to paragraph (3)(b), the surrogate 14 parent must approve the program before it is incorporated into 15 the child’s case plan. However, in order for a home education 16 program to be approved, the foster parent must: 17 (a) Provide a notarized statement by the school district to 18 verify that the parent has successfully conducted and completed 19 3 consecutive years of a home education program; and 20 (b) Select a certified teacher, psychologist, mental health 21 professional, nurse, or doctor who is licensed by the state and 22 is willing to meet with the child at least once a month and 23 provide a written report to the court which addresses the well 24 being of the child. The licensed professional must be approved 25 by the community-based care agency and the court and 26 incorporated into the child’s case plan. 27 28 ================= T I T L E A M E N D M E N T ================ 29 And the title is amended as follows: 30 Delete line 9 31 and insert: 32 having a disability; providing for a child who is 33 living in a foster home to be enrolled in or change 34 his or her school setting to a home education program 35 or a public or private school scholarship program 36 under certain circumstances; providing conditions for 37 a foster parent to meet before receiving approval for 38 such enrollment or change in school setting; amending 39 s. 39.202, F.S.;
