6 | Be It Enacted by the Legislature of the State of Florida: |

8 | Section 1. Disclosure of certain contract provisions.-- |
9 | (1) All contracts for goods or services shall |
10 | conspicuously disclose the following: |
11 | (a) Any conditions placed upon the right to terminate the |
12 | contract, including any provisions that provide for a right to |
13 | cure. |
14 | (b) Any conditions or procedures relating to breach of |
15 | contract or remedies for breach of contract, including any |
16 | provisions related to arbitration. |
17 | (2) All disclosures of contract provisions under |
18 | subsection (1) must be in bold type and placed within a separate |
19 | paragraph. |
20 | (3) A contract containing provisions provided in |
21 | subsection (1) shall provide, in immediate proximity to each of |
22 | the provisions, a space reserved in the contract for the |
23 | signature of all parties to specifically acknowledge having read |
24 | each of such provisions. Failure to provide such spaces for |
25 | signature and to obtain the signatures of all parties shall |
26 | render the applicable contract provisions void and |
27 | unenforceable. |
28 | (4) For purposes of this section, the term "conspicuously" |
29 | means so written, displayed, or presented that a reasonable |
30 | person against whom it is to operate ought to have noticed it. |
31 | Section 2. This act shall take effect July 1, 2009, and |
32 | shall apply to contracts entered into on or after that date. |
