       Senator King moved the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 66 - 82
    4  and insert:
    5         (c)“Class III clean energy source” means clean energy
    6  derived from nuclear energy or any fossil fuel generation for
    7  which carbon capture and sequestration plans have been approved
    8  by the Department of Environmental Protection.
    9         (d)“Clean energy” means electrical energy produced from a
   10  method that uses one or more of the following fuels or energy
   11  sources: nuclear energy placed in commercial service after July
   12  1, 2009, any fossil fuel generation for which carbon capture and
   13  sequestration plans have been approved by the Department of
   14  Environmental Protection, hydrogen produced from sources other
   15  than fossil fuels, biomass, solar photovoltaic, geothermal
   16  energy, wind energy, ocean energy, or hydroelectric power. The
   17  term includes waste heat from sulfuric acid manufacturing
   18  operations and waste heat thermal energy which is produced by a
   19  combined heat and power system placed in service in this state
   20  after July 1, 2009, and which is used to produce biofuel and any
   21  associated coproducts.
