Florida Senate - 2009 SB 1156 By Senator King 8-00997-09 20091156__ 1 A bill to be entitled 2 An act relating to trust funds; creating the Florida 3 Renewable Energy Trust Fund within the Florida Energy 4 and Climate Commission; requiring that the commission 5 administer the fund; providing that moneys deposited 6 into the fund be from federal grants for renewable 7 energy; providing a purpose for the fund; requiring 8 that any balance remain in the trust fund at the end 9 of each fiscal year; providing for future review and 10 termination or re-creation of the trust fund; 11 providing a contingent effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. (1) The Florida Renewable Energy Trust Fund is 16 created within, and shall be administered by, the Florida Energy 17 and Climate Commission. Moneys deposited in the fund shall be 18 from federal grants made available for renewable energy. The 19 purpose of the trust fund is to provide funding to facilitate 20 the development and implementation of renewable energy and 21 energy efficiency programs and projects. 22 (2) Notwithstanding s. 216.301, Florida Statutes, and 23 pursuant to s. 216.351, Florida Statutes, any balance in the 24 trust fund at the end of the fiscal year shall remain in the 25 trust fund at the end of the fiscal year and be available for 26 carrying out the purpose of the trust fund. 27 (3) In accordance with Section 19(f)(2), Article III of the 28 State Constitution, the trust fund shall, unless terminated 29 sooner, be terminated on July 1, 2013. Before its scheduled 30 termination, the trust fund shall be reviewed as provided in s. 31 215.3206(1) and (2), Florida Statutes. 32 Section 2. This act shall take effect July 1, 2009, but it 33 shall not take effect unless it is enacted by a three-fifths 34 vote of the membership of each house of the Legislature.
