Florida Senate - 2009 CS for CS for SB 1156 By the Committees on Environmental Preservation and Conservation; and Communications, Energy, and Public Utilities; and Senator King 592-04376-09 20091156c2 1 A bill to be entitled 2 An act relating to trust funds; creating the Florida 3 Renewable Energy Trust Fund within the Florida Energy 4 and Climate Commission; requiring that the commission 5 administer the fund; providing that moneys deposited 6 into the fund be from federal grants for renewable 7 energy, general revenue appropriations, and other 8 sources designated by law; providing a purpose for the 9 fund; requiring that any balance remain in the trust 10 fund at the end of each fiscal year; providing for 11 future review and termination or re-creation of the 12 trust fund; providing a contingent effective date. 13 14 Be It Enacted by the Legislature of the State of Florida: 15 16 Section 1. Florida Renewable Energy Trust Fund.— 17 (1) The Florida Renewable Energy Trust Fund is created 18 within, and shall be administered by, the Florida Energy and 19 Climate Commission. Moneys deposited into the trust fund shall 20 be from federal grants made available for renewable energy, 21 moneys appropriated from general revenue, donations, and other 22 sources designated by law. The purpose of the trust fund is to 23 provide funding to facilitate the development and implementation 24 of renewable energy and energy-efficiency programs and projects. 25 (2) Notwithstanding s. 216.301, Florida Statutes, and 26 pursuant to s. 216.351, Florida Statutes, any balance in the 27 trust fund at the end of the fiscal year shall remain in the 28 trust fund at the end of the fiscal year and be available for 29 carrying out the purpose of the trust fund. 30 (3) In accordance with Section 19(f)(2), Article III of the 31 State Constitution, the trust fund shall, unless terminated 32 sooner, be terminated on July 1, 2013. Before its scheduled 33 termination, the trust fund shall be reviewed as provided in s. 34 215.3206(1) and (2), Florida Statutes. 35 Section 2. This act shall take effect July 1, 2009, but it 36 shall not take effect unless it is enacted by a three-fifths 37 vote of the membership of each house of the Legislature.
