2 | An act relating to the Cities of Leesburg, Tavares, and |
3 | Eustis, Lake County; authorizing the Division of Alcoholic |
4 | Beverages and Tobacco of the Department of Business and |
5 | Professional Regulation to issue up to a specified number |
6 | of temporary permits to nonprofit civic organizations to |
7 | sell alcoholic beverages for consumption on the premises |
8 | at outdoor events on public rights-of-way and public parks |
9 | in the downtown areas of Leesburg, Tavares, and Eustis; |
10 | providing that such events require a special event permit |
11 | from the particular city; providing that the permits |
12 | authorized by the act are in addition to certain other |
13 | authorized temporary permits; requiring the nonprofit |
14 | civic organization to comply with certain statutory |
15 | requirements in obtaining the permits authorized by the |
16 | act; requiring the division to adopt rules; providing an |
17 | effective date. |

19 | Be It Enacted by the Legislature of the State of Florida: |
20 |
|
21 | Section 1. (1) Notwithstanding any other provision of |
22 | law, the Division of Alcoholic Beverages and Tobacco of the |
23 | Department of Business and Professional Regulation may issue to |
24 | a bona fide nonprofit civic organization, upon application and |
25 | presentation of a valid special event permit issued by the City |
26 | of Leesburg, the City of Tavares, or the City of Eustis, a |
27 | temporary permit authorizing the sale of alcoholic beverages for |
28 | consumption on the premises at outdoor events on public rights- |
29 | of-way and public parks in the downtown area of Leesburg, |
30 | Tavares, or Eustis. Any such nonprofit civic organization may be |
31 | issued up to 15 temporary permits per calendar year, and each |
32 | temporary permit shall be valid for up to 3 days. For purposes |
33 | of this act: |
34 | (a) The downtown area of Leesburg is that area bounded by |
35 | North Boulevard on the north, Lake Street on the east, Dixie |
36 | Avenue on the south, and 12th Street and Perkins Street on the |
37 | west. |
38 | (b) The downtown area of Tavares is that area bounded by |
39 | U.S. Highway 441 on the north, St. Clair Abrams Avenue on the |
40 | east, State Road 19 on the west, and Lake Dora on the south. |
41 | (c) The downtown area of Eustis is that area described as |
42 | follows: Begin at the Western Right-of-Way of Northshore Drive |
43 | at the intersection of the Northern Right-of-Way of Wilt Avenue; |
44 | thence run East along the Northern Right-of-Way of Wilt Avenue |
45 | to the Eastern Right-of-Way of North Grove Street; thence run |
46 | South along the Eastern Right-of-Way of North Grove Street |
47 | (a/k/a SR 19 North) to the Northern Right-of-Way of Bates |
48 | Avenue; thence run East along the Northern Right-of-Way of Bates |
49 | Avenue to the Eastern Right-of-Way of Dewey Street; thence run |
50 | South along the Eastern Right-of-Way of Dewey Street to the |
51 | Southern Right-of-Way of Citrus Avenue; thence run West along |
52 | the Southern Right-of-Way of Citrus Avenue to the Eastern Right- |
53 | of-Way of North Grove Street (a/k/a SR 19 North); thence run |
54 | South along the eastern Right-of-Way of North Grove Street |
55 | (a/k/a SR 19 North) to the Southern Right-of-Way of Ward Street; |
56 | thence run West along the Southern Right of Way of Ward Street |
57 | to the Eastern Right-of-Way of Donnelly Street; thence run South |
58 | along the Eastern Right-of-Way of Donnelly Street to the |
59 | Southern Right-of-Way of West Woodward Avenue; thence run West |
60 | along the Southern Right-of-Way of West Woodward Avenue to Lake |
61 | Eustis; thence run North along the waters edge of Lake Eustis |
62 | and landward to the intersection of the Western Right-of-Way of |
63 | Northshore Drive and the Northern Right-of-Way of Wilt Avenue |
64 | and the point of beginning. |
65 | (2) The temporary permits authorized by this act are in |
66 | addition to the three temporary permits authorized per year for |
67 | a nonprofit civic organization pursuant to section 561.422, |
68 | Florida Statutes. |
69 | (3) The nonprofit civic organization shall comply with all |
70 | other requirements of section 561.422, Florida Statutes, in |
71 | obtaining the temporary permits authorized by this act. |
72 | (4) On or before October 1, 2009, the Division of |
73 | Alcoholic Beverages and Tobacco of the Department of Business |
74 | and Professional Regulation shall adopt rules pursuant to |
75 | chapter 20, Florida Statutes, to administer this act. Such rules |
76 | shall include permitting procedures and application forms. |
77 | Section 2. This act shall take effect upon becoming a law. |
