A bill to be entitled
2An act relating to the Cities of Leesburg, Tavares, and
3Eustis, Lake County; authorizing the Division of Alcoholic
4Beverages and Tobacco of the Department of Business and
5Professional Regulation to issue up to a specified number
6of temporary permits to nonprofit civic organizations to
7sell alcoholic beverages for consumption on the premises
8at outdoor events on public rights-of-way and public parks
9in the downtown areas of Leesburg, Tavares, and Eustis;
10providing that such events require a special event permit
11from the particular city; providing that the permits
12authorized by the act are in addition to certain other
13authorized temporary permits; requiring the nonprofit
14civic organization to comply with certain statutory
15requirements in obtaining the permits authorized by the
16act; requiring the division to adopt rules; providing an
17effective date.

19Be It Enacted by the Legislature of the State of Florida:

21     Section 1.  (1)  Notwithstanding any other provision of
22law, the Division of Alcoholic Beverages and Tobacco of the
23Department of Business and Professional Regulation may issue to
24a bona fide nonprofit civic organization, upon application and
25presentation of a valid special event permit issued by the City
26of Leesburg, the City of Tavares, or the City of Eustis, a
27temporary permit authorizing the sale of alcoholic beverages for
28consumption on the premises at outdoor events on public rights-
29of-way and public parks in the downtown area of Leesburg,
30Tavares, or Eustis. Any such nonprofit civic organization may be
31issued up to 15 temporary permits per calendar year, and each
32temporary permit shall be valid for up to 3 days. For purposes
33of this act:
34     (a)  The downtown area of Leesburg is that area bounded by
35North Boulevard on the north, Lake Street on the east, Dixie
36Avenue on the south, and 12th Street and Perkins Street on the
37west.
38     (b)  The downtown area of Tavares is that area bounded by
39U.S. Highway 441 on the north, St. Clair Abrams Avenue on the
40east, State Road 19 on the west, and Lake Dora on the south.
41     (c)  The downtown area of Eustis is that area described as
42follows: Begin at the Western Right-of-Way of Northshore Drive
43at the intersection of the Northern Right-of-Way of Wilt Avenue;
44thence run East along the Northern Right-of-Way of Wilt Avenue
45to the Eastern Right-of-Way of North Grove Street; thence run
46South along the Eastern Right-of-Way of North Grove Street
47(a/k/a SR 19 North) to the Northern Right-of-Way of Bates
48Avenue; thence run East along the Northern Right-of-Way of Bates
49Avenue to the Eastern Right-of-Way of Dewey Street; thence run
50South along the Eastern Right-of-Way of Dewey Street to the
51Southern Right-of-Way of Citrus Avenue; thence run West along
52the Southern Right-of-Way of Citrus Avenue to the Eastern Right-
53of-Way of North Grove Street (a/k/a SR 19 North); thence run
54South along the eastern Right-of-Way of North Grove Street
55(a/k/a SR 19 North) to the Southern Right-of-Way of Ward Street;
56thence run West along the Southern Right of Way of Ward Street
57to the Eastern Right-of-Way of Donnelly Street; thence run South
58along the Eastern Right-of-Way of Donnelly Street to the
59Southern Right-of-Way of West Woodward Avenue; thence run West
60along the Southern Right-of-Way of West Woodward Avenue to Lake
61Eustis; thence run North along the waters edge of Lake Eustis
62and landward to the intersection of the Western Right-of-Way of
63Northshore Drive and the Northern Right-of-Way of Wilt Avenue
64and the point of beginning.
65     (2)  The temporary permits authorized by this act are in
66addition to the three temporary permits authorized per year for
67a nonprofit civic organization pursuant to section 561.422,
68Florida Statutes.
69     (3)  The nonprofit civic organization shall comply with all
70other requirements of section 561.422, Florida Statutes, in
71obtaining the temporary permits authorized by this act.
72     (4)  On or before October 1, 2009, the Division of
73Alcoholic Beverages and Tobacco of the Department of Business
74and Professional Regulation shall adopt rules pursuant to
75chapter 20, Florida Statutes, to administer this act. Such rules
76shall include permitting procedures and application forms.
77     Section 2.  This act shall take effect upon becoming a law.
