A bill to be entitled
2An act relating to the City of Leesburg, Lake County;
3authorizing the Division of Alcoholic Beverages and
4Tobacco of the Department of Business and Professional
5Regulation to issue up to a specified number of temporary
6permits to nonprofit civic organizations to sell alcoholic
7beverages for consumption on the premises at outdoor
8events on public rights-of-way and public parks in the
9downtown area of Leesburg; providing that such events
10require a special event permit from the city; providing
11that the permits authorized by the act are in addition to
12certain other authorized temporary permits; requiring the
13nonprofit civic organization to comply with certain
14statutory requirements in obtaining the permits authorized
15by the act; requiring the division to adopt rules;
16providing an effective date.

18Be It Enacted by the Legislature of the State of Florida:

20     Section 1.  (1)  Notwithstanding any other provision of
21law, the Division of Alcoholic Beverages and Tobacco of the
22Department of Business and Professional Regulation may issue to
23a bona fide nonprofit civic organization, upon application and
24presentation of a valid special event permit issued by the City
25of Leesburg, a temporary permit authorizing the sale of
26alcoholic beverages for consumption on the premises at outdoor
27events on public rights-of-way and public parks in the downtown
28area of Leesburg. Any such nonprofit civic organization may be
29issued up to 15 temporary permits per calendar year, and each
30temporary permit shall be valid for up to 3 days. For purposes
31of this act, the downtown area of Leesburg is that area bounded
32by North Boulevard on the north, Lake Street on the east, Dixie
33Avenue on the south, and 12th Street and Perkins Street on the
34west.
35     (2)  The temporary permits authorized by this act are in
36addition to the three temporary permits authorized per year for
37a nonprofit civic organization pursuant to section 561.422,
38Florida Statutes.
39     (3)  The nonprofit civic organization shall comply with all
40other requirements of section 561.422, Florida Statutes, in
41obtaining the temporary permits authorized by this act.
42     (4)  On or before October 1, 2009, the Division of
43Alcoholic Beverages and Tobacco of the Department of Business
44and Professional Regulation shall adopt rules pursuant to
45chapter 20, Florida Statutes, to administer this act. Such rules
46shall include permitting procedures and application forms.
47     Section 2.  This act shall take effect upon becoming a law.
