1	A bill to be entitled
2	An act relating to the City of Leesburg, Lake County;
3	authorizing the Division of Alcoholic Beverages and
4	Tobacco of the Department of Business and Professional
5	Regulation to issue up to a specified number of temporary
6	permits to nonprofit civic organizations to sell alcoholic
7	beverages for consumption on the premises at outdoor
8	events on public rights-of-way and public parks in the
9	downtown area of Leesburg; providing that such events
10	require a special event permit from the city; providing
11	that the permits authorized by the act are in addition to
12	certain other authorized temporary permits; requiring the
13	nonprofit civic organization to comply with certain
14	statutory requirements in obtaining the permits authorized
15	by the act; requiring the division to adopt rules;
16	providing an effective date.

18	Be It Enacted by the Legislature of the State of Florida:

20	Section 1.  (1)  Notwithstanding any other provision of
21	law, the Division of Alcoholic Beverages and Tobacco of the
22	Department of Business and Professional Regulation may issue to
23	a bona fide nonprofit civic organization, upon application and
24	presentation of a valid special event permit issued by the City
25	of Leesburg, a temporary permit authorizing the sale of
26	alcoholic beverages for consumption on the premises at outdoor
27	events on public rights-of-way and public parks in the downtown
28	area of Leesburg. Any such nonprofit civic organization may be
29	issued up to 15 temporary permits per calendar year, and each
30	temporary permit shall be valid for up to 3 days. For purposes
31	of this act, the downtown area of Leesburg is that area bounded
32	by North Boulevard on the north, Lake Street on the east, Dixie
33	Avenue on the south, and 12th Street and Perkins Street on the
34	west.
35	(2)  The temporary permits authorized by this act are in
36	addition to the three temporary permits authorized per year for
37	a nonprofit civic organization pursuant to section 561.422,
38	Florida Statutes.
39	(3)  The nonprofit civic organization shall comply with all
40	other requirements of section 561.422, Florida Statutes, in
41	obtaining the temporary permits authorized by this act.
42	(4)  On or before October 1, 2009, the Division of
43	Alcoholic Beverages and Tobacco of the Department of Business
44	and Professional Regulation shall adopt rules pursuant to
45	chapter 20, Florida Statutes, to administer this act. Such rules
46	shall include permitting procedures and application forms.
47	Section 2.  This act shall take effect upon becoming a law.
