3     Amendment (with title amendment)
4     Remove lines 118-148 and insert:
5     Section 6.  Subsection (10) is added to section 320.03,
6Florida Statutes, to read:
7     320.03  Registration; duties of tax collectors;
8International Registration Plan.--
9     (10)  Jurisdiction over the outsourced electronic filing
10system for use by licensed motor vehicle dealers electronically
11to title and to register motor vehicles and to issue or to
12transfer registration license plates or decals is expressly
13preempted to the state. The department shall continue its
14current outsourcing of the existing electronic filing system,
15including its program standards. The electronic filing system is
16approved for use in all counties, shall apply uniformly to all
17tax collectors of the state, and no tax collector may add or
18detract from the program standards in his or her respective
19county. A motor vehicle dealer licensed under this chapter may
20charge a fee to the customer for use of the electronic filing
21system and such fee is not a component of the program standards.
22Final authority over disputes relating to program standards lies
23with the department. By January 1, 2010, the Office of Program
24Policy Analysis and Government Accountability, with input from
25the department and from affected parties, including tax
26collectors, service providers, and motor vehicle dealers, shall
27report to the President of the Senate and the Speaker of the
28House of Representatives on the status of the outsourced
29electronic filing system, including the program standards, and
30its compliance with this subsection. The report shall identify
31all public and private alternatives for continued operation of
32the electronic filing system and shall include any and all
33appropriate recommendations, including revisions to the program
34standards.

41department to continue its current outsourcing of the existing
42electronic filing system; approving the system for use in all
43counties; authorizing motor vehicle dealers to charge certain
44fees; requiring a report from the Office of Program Policy
45Analysis and Government Accountability by a specified date;
