| 2 | An act relating to the Marriage Education Trust Fund; |

| 5 | Governor; providing for administration of the trust fund |
| 6 | and use of moneys therein; providing for future review and |
| 7 | termination or re-creation of the trust fund; providing a |
| 8 | contingent effective date. |

| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |
|
| 12 | Section 1. Section 741.0101, Florida Statutes, is created |
| 13 | to read: |
| 14 | 741.0101 Marriage Education Trust Fund.-- |
| 15 | (1) The Marriage Education Trust Fund is created within |
| 16 | the Executive Office of the Governor for the purpose of |
| 17 | collecting and disbursing funds generated from the additional |
| 18 | marriage license fee in s. 741.01(4)(b). The funds shall be |
| 19 | directed to the Department of Children and Family Services for |
| 20 | the specific purpose of funding marriage education programs that |
| 21 | prepare, strengthen, and restore healthy marriage relationships |
| 22 | and shall be appropriated in a grants-in-aid category to the |
| 23 | department for that purpose. |
| 24 | (2) Pursuant to the provisions of s. 19(f)(2), Art. III of |
| 25 | the State Constitution, the trust fund shall, unless terminated |
| 26 | sooner, be terminated on July 1, 2013. Prior to its scheduled |
| 27 | termination, the trust fund shall be reviewed as provided in s. |
| 28 | 215.3206(1) and (2). |
| 29 | Section 2. This act shall take effect July 1, 2009, if |
| 30 | House Bill 1185 or similar legislation is adopted in the same |
| 31 | legislative session or an extension thereof and becomes law. |
