    1         Senate Amendment

    3         Between lines 391 and 392
    4  insert:
    5         (d) The department shall have no indemnification
    6  obligations to any freight rail operator or third party for any
    7  exemplary damages awarded against such freight rail operator or
    8  third party attributable to the conduct of the freight rail
    9  operator or third party.
