       The Committee on Transportation (Dockery) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete line 383
    4  and insert:
    5         (18) Have no indemnification obligations to any freight
    6  rail operator or third party for any exemplary damages awarded
    7  against the freight rail operator or third party attributable to
    8  the conduct of the freight rail operator or third party.
    9         (19)(17) Exercise such other functions, powers, and duties
   10

   12         And the title is amended as follows:
   13         Delete line 23
   14  and insert:
   15  
   16  right-of-way; providing that the Department of Transportation
   17  has no indemnification obligations to any freight rail operator
   18  or third party for exemplary damages awarded against the freight
   19  rail operator or third party attributable to the conduct of the
   20  freight rail operator or third party; providing an effective
   21  date.
