       Appropriations (Dockery) recommended the following:
       
    1         Senate Amendment to Amendment (953772) (with title
    2  amendment)

    4         Between lines 376 and 377
    5  insert:
    6  The department is not obligated to indemnify any freight rail
    7  operator or third party for any exemplary damages awarded
    8  against such freight rail operator or third party attributable
    9  to the conduct of the freight rail operator or third party.

   14  and insert:
