       Appropriations (Dockery) recommended the following:

    4  insert:

    6         (d) Notwithstanding any other provision in this section,
    7  the department shall have no indemnification obligations to any
    8  freight rail operator or third party until such time that
    9  commuter rail is operating in the rail corridor.
