       The Committee on Judiciary (Peaden) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 254 - 256
    4  and insert:
    5         (17) After the Legislature has established a dedicated
    6  funding source of not less than $45 million annually for the
    7  benefit of the South Florida Regional Transportation Authority
    8  for use in the Tri-Rail Commuter Rail corridor in Miami-Dade,
    9  Broward, and Palm Beach Counties, have the authority to purchase
   10  the required right-of-way improvements and appurtenances of the
   11  A-Line rail corridor from CSX Transportation, Inc., for the
   12  primary purpose of implementing commuter rail service in central
   13  Florida. If a dedicated funding source sufficient to cover
   14  operations and maintenance of any new commuter rail corridor has
   15  been established by law or by contract, in conjunction with the
   16  acquisition, ownership, construction, operation, maintenance,
   17  and management of such commuter rail corridor, the department
   18  may:

   23         Delete line 9
   24  and insert:

   26         rail system plan and requiring a report; providing
   27         that if the Legislature establishes a dedicated
   28         funding source of a specified amount for the benefit
   29         of the Tri-Rail Commuter Rail corridor, the department
   30         may purchase the required right-of-way improvements
   31         and appurtenances of the A-Line rail corridor from CSX
   32         Transportation, Inc., for the primary purpose of
   33         implementing commuter rail service in central Florida;
   34         providing that if the Legislature establishes a
   35         dedicated funding source to cover operations and
   36         maintenance of any new commuter rail corridor, the
   37         department may exercise additional duties relating to
   38         commuter rail service; providing
