       The Committee on Judiciary (Gelber) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete line 383
    4  and insert:

    6         (18) Have no indemnification obligations to any freight
    7  rail operator or third party for any exemplary damages awarded
    8  against the freight rail operator or third party attributable to
    9  the conduct of the freight rail operator or third party.
   10         (19)(17) Exercise such other functions, powers, and duties
   11

   13  And the title is amended as follows:

   15         Delete line 23
   16  and insert:

   18         right-of-way; providing that the Department of
   19         Transportation has no indemnification obligations to

   22         third party attributable to the conduct of the freight
   23         rail operator or third party; providing an effective
   24         date.
