       The Committee on Transportation and Economic Development
       Appropriations (Dockery) recommended the following:
       
    1         Senate Amendment to Amendment (356220) (with title
    2  amendment)
    3  
    4         Between lines 437 and 438
    5  insert:
    6         Section 5. (1)The Department of Transportation may not
    7  guarantee funding for the operation or maintenance of any
    8  commuter rail corridor or system without a specific and discreet
    9  legislative authorization. The guarantee may not be a part of
   10  any other subject matter bill or legislative package.
   11         (2)The Department of Transportation may not support any
   12  new commuter rail corridor otherwise authorized by the
   13  department until federal, state, and local governments have
   14  established a dedicated funding source to pay for the corridor
   15  and the associated operation and maintenance of a commuter rail
   16  system.

   20  And the title is amended as follows:

   22         Delete line 476
   23  and insert:
   24         prohibiting the Department of Transportation from
   25         guaranteeing funding for the operation or maintenance
   26         of any commuter rail corridor or system without a
   27         specific and discreet legislative authorization;
   28         prohibiting the Department of Transportation from
   29         supporting any new commuter rail corridor otherwise
   30         authorized by the department until federal, state, and
   31         local governments have established a dedicated funding
   32         source to pay for the corridor and the associated
   33         operation and maintenance of a commuter rail system;
   34         providing an effective date.
