A bill to be entitled
2An act relating to voyeurism; amending s. 810.14, F.S.;
3prohibiting secretly viewing, for specified purposes,
4either under or through the clothing being worn by another
5person without that person's knowledge or consent in order
6to view the body of, or the undergarments worn by, that
7person; providing penalties; providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Section 810.14, Florida Statutes, is amended to
12read:
13     810.14  Voyeurism prohibited; penalties.--
14     (1)  A person commits the offense of voyeurism if that
15person:
16     (a)  when he or she, With lewd, lascivious, or indecent
17intent, secretly observes another person when the other person
18is located in a dwelling, structure, or conveyance and such
19location provides a reasonable expectation of privacy; or
20     (b)  For amusement, entertainment, or sexual arousal or
21gratification, secretly views either under or through the
22clothing being worn by another person without that person's
23knowledge or consent in order to view the body of, or the
24undergarments worn by, that person.
25     (2)  A person who violates this section commits a
26misdemeanor of the first degree for the first violation,
27punishable as provided in s. 775.082 or s. 775.083.
28     (3)  A person who violates this section and who has been
29previously convicted or adjudicated delinquent two or more times
30of any violation of this section commits a felony of the third
31degree, punishable as provided in s. 775.082, s. 775.083, or s.
32775.084.
33     (4)  For purposes of this section, a person has been
34previously convicted or adjudicated delinquent of a violation of
35this section if the violation resulted in a conviction sentenced
36separately, or an adjudication of delinquency entered
37separately, prior to the current offense.
38     Section 2.  This act shall take effect October 1, 2009.
