    1                        A bill to be entitled                      
    2         An act relating to public K-12 instructional
    3         materials; amending s. 1006.28, F.S.; deleting a
    4         provision that requires a public school principal to
    5         collect 50 to 75 percent of a textbook's purchase
    6         price from a student who has lost, destroyed, or
    7         damaged a textbook that has been in use for more than
    8         1 year; providing an effective date.
    9         
   10  Be It Enacted by the Legislature of the State of Florida:
   11         
   12         Section 1. Paragraph (b) of subsection (3) of section
   13  1006.28, Florida Statutes, is amended to read:
   14         1006.28 Duties of district school board, district school
   15  superintendent; and school principal regarding K-12
   16  instructional materials.—
   17         (3) SCHOOL PRINCIPAL.—The school principal has the
   18  following duties for the management and care of instructional
   19  materials at the school:
   20         (b) Money collected for lost or damaged books;
   21  enforcement.—The school principal shall collect from each
   22  student or the student's parent the purchase price of any
   23  instructional material the student has lost, destroyed, or
   24  unnecessarily damaged and to report and transmit the money
   25  collected to the district school superintendent. If
   26  instructional materials lost, destroyed, or damaged have been in
   27  school use for more than 1 year, a sum ranging between 50 and 75
   28  percent of the purchase price of the book shall be collected,
   29  determined by the physical condition of the book. The failure to
   30  collect such sum upon reasonable effort by the school principal
   31  may result in the suspension of the student from participation
   32  in extracurricular activities or satisfaction of the debt by the
   33  student through community service activities at the school site
   34  as determined by the school principal, pursuant to policies
   35  adopted by district school board rule.
   36         Section 2. This act shall take effect July 1, 2009.
