A bill to be entitled
2An act relating to the conveyance of bodies into or out of
3the state; amending s. 406.61, F.S.; authorizing certain
4accredited institutions or organizations to convey
5plastinated bodies into or out of the state for exhibition
6and public educational purposes; requiring that the
7institution or organization provide prior notification and
8documentation to the anatomical board; providing an
9effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Section 406.61, Florida Statutes, is amended to
14read:
15     406.61  Selling, buying, or conveying bodies outside state
16prohibited; exceptions, penalty.--Any person who sells shall
17sell or buys buy any body or parts of bodies as described in
18this chapter or any person except a recognized Florida medical
19or dental school who transmits shall transmit or conveys convey
20or causes cause to be transmitted or conveyed such body or parts
21of bodies to any place outside this state commits is guilty of a
22misdemeanor of the first degree, punishable as provided in ss.
23775.082 and 775.083. However, nothing in this chapter does not
24prohibit shall be construed as prohibiting the anatomical board
25from transporting human specimens outside the state for
26educational or scientific purposes or prohibit as prohibiting
27the transport of bodies, parts of bodies, or tissue specimens in
28furtherance of lawful examination, investigation, or autopsy
29conducted pursuant to s. 406.11. Any person, institution, or
30organization that conveys bodies or parts of bodies into or out
31of the state for medical education or research purposes shall
32notify the anatomical board of such intent and receive approval
33from the board. Any institution or organization accredited by
34the American Association of Museums may convey plastinated
35bodies or parts of bodies into or out of the state for
36exhibition and public educational purposes without the consent
37of the board if the institution or organization notifies the
38board of the conveyance and the duration and location of the
39exhibition at least 30 days before the intended conveyance and
40provides documentation that the bodies were legally donated for
41the purpose of plastinization.
42     Section 2.  This act shall take effect July 1, 2009.
