| 6 | purposes; requiring prior notification to the anatomical |
| 7 | board; requiring written certification concerning the |
| 8 | manner in which the plastinated bodies or parts of bodies |
| 9 | were made available; providing an effective date. |

| 11 | Be It Enacted by the Legislature of the State of Florida: |
| 12 |
|
| 13 | Section 1. Section 406.61, Florida Statutes, is amended to |
| 14 | read: |
| 15 | 406.61 Selling, buying, or conveying bodies outside state |
| 16 | prohibited; exceptions, penalty.-- |
| 17 | (1) Any person who sells shall sell or buys buy any body |
| 18 | or parts of bodies as described in this chapter or any person |
| 19 | except a recognized Florida medical or dental school who |
| 20 | transmits shall transmit or conveys convey or causes cause to be |
| 21 | transmitted or conveyed such body or parts of bodies to any |
| 22 | place outside this state commits is guilty of a misdemeanor of |
| 23 | the first degree, punishable as provided in ss. 775.082 and |
| 24 | 775.083. However, nothing in this chapter does not prohibit |
| 25 | shall be construed as prohibiting the anatomical board from |
| 26 | transporting human specimens outside the state for educational |
| 27 | or scientific purposes or prohibit as prohibiting the transport |
| 28 | of bodies, parts of bodies, or tissue specimens in furtherance |
| 29 | of lawful examination, investigation, or autopsy conducted |
| 30 | pursuant to s. 406.11. Any person, institution, or organization |
| 31 | that conveys bodies or parts of bodies into or out of the state |
| 32 | for medical education or research purposes shall notify the |
| 33 | anatomical board of such intent and receive approval from the |
| 34 | board. |
| 35 | (2) Any entity accredited by the American Association of |
| 36 | Museums, or any science museum defined in s. 265.608 that is |
| 37 | designated a cultural sponsoring organization by the Department |
| 38 | of State pursuant to the Cultural Endowment Program under ss. |
| 39 | 265.601-265.606, may convey plastinated bodies or parts of |
| 40 | bodies into or out of the state for exhibition and public |
| 41 | educational purposes without the consent of the board if the |
| 42 | accredited entity or science museum: |
| 43 | (a) Notifies the board of the conveyance and the duration |
| 44 | and location of the exhibition at least 30 days before the |
| 45 | intended conveyance. |
| 46 | (b) Certifies in writing that the accredited entity or |
| 47 | science museum does not have any knowledge or reason to believe |
| 48 | that the plastinated bodies or parts of bodies were made |
| 49 | available through an unlawful act. |
| 50 | Section 2. This act shall take effect July 1, 2009. |
