A bill to be entitled
2An act relating to the conveyance of bodies into or out of
3the state; amending s. 406.61, F.S.; authorizing
4accredited entities and certain science museums to convey
5plastinated bodies or parts of bodies for certain
6purposes; requiring prior notification to the anatomical
7board; requiring written certification concerning the
8manner in which the plastinated bodies or parts of bodies
9were made available; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Section 406.61, Florida Statutes, is amended to
14read:
15     406.61  Selling, buying, or conveying bodies outside state
16prohibited; exceptions, penalty.--
17     (1)  Any person who sells shall sell or buys buy any body
18or parts of bodies as described in this chapter or any person
19except a recognized Florida medical or dental school who
20transmits shall transmit or conveys convey or causes cause to be
21transmitted or conveyed such body or parts of bodies to any
22place outside this state commits is guilty of a misdemeanor of
23the first degree, punishable as provided in ss. 775.082 and
24775.083. However, nothing in this chapter does not prohibit
25shall be construed as prohibiting the anatomical board from
26transporting human specimens outside the state for educational
27or scientific purposes or prohibit as prohibiting the transport
28of bodies, parts of bodies, or tissue specimens in furtherance
29of lawful examination, investigation, or autopsy conducted
30pursuant to s. 406.11. Any person, institution, or organization
31that conveys bodies or parts of bodies into or out of the state
32for medical education or research purposes shall notify the
33anatomical board of such intent and receive approval from the
34board.
35     (2)  Any entity accredited by the American Association of
36Museums, or any science museum defined in s. 265.608 that is
37designated a cultural sponsoring organization by the Department
38of State pursuant to the Cultural Endowment Program under ss.
39265.601-265.606, may convey plastinated bodies or parts of
40bodies into or out of the state for exhibition and public
41educational purposes without the consent of the board if the
42accredited entity or science museum:
43     (a)  Notifies the board of the conveyance and the duration
44and location of the exhibition at least 30 days before the
45intended conveyance.
46     (b)  Certifies in writing that the accredited entity or
47science museum does not have any knowledge or reason to believe
48that the plastinated bodies or parts of bodies were made
49available through an unlawful act.
50     Section 2.  This act shall take effect July 1, 2009.
